What was the problem with them?
No problem, except they have a few scratches on them, when I got them, but that's not the reason, price has been reduced by a bit
#3
They were obviously broken the first time you used them and this is the first opportunity you've had to return them.... I'm guessing this is your reason

Price reduced by £40, since I bought it

If they are scratched thats a good enough reason. Could be seconds. Same happened to me with another company and on further inspection they were used. Take photos,

Under the distance selling regulations you don't need any reason other than changed your mind in order to return them.

Or just buy the new one and send back the new sealed one with the old receipt?

But I opened them and have used them, when I contacted game they told me to take a hike, but I forgot to mention the scratches to them

Not really.
They get the same product back and you get the product at a reduced price.
Other retailers offer to give you the difference back if it's reduced in a certain amount of time.

on my moral compass the needle for that one points to sneaky.

Basically you only have to tell them you don't want them anymore and changed your mind. They can't argue with it unless you have caused damage to the product, which is a different matter.
