bought a phone from the car phone warehouse, Its stopped working after 3 month

phone has stopped working after 3 months to be told I would have to send it
back to the manufacturer myself, quoted the sale of goods act saying I bought
it off them so they would have to replace it, still told I would have to send back myself.
any one knew if this is right?

Dont settle for their bs. Your contract is with them. They have your money. Sale of goods act covers you. Witnin 6 months its their responsibility to prove it wasnt faulty, which they cant.

Carphonewarehouse should take it back if not just go to another store and try return there.

Have a read of the terms and conditions of sale. Soga states that if a problem arises within six months of buying the product, it's up to the retailer to prove that the goods were of satisfactory quality, fit for purpose, or as described when it sold them.

Did you call them or go in store? Trading standards would also tell you to go directly to the retailer as they're liable for any problems until the first year at least.

The merchant must deal with the problem, if they want to send it to the manufacturer for repair it is their choice but do not go directly to the manufacturer because then you have no come back with CPW. I would try to speak to them again, ask for the manager if necessary. If still no joy then ring the head office. Take note of the managers name and the store location.

Contact Trading Standards or Citizens Advice - but would not recommend you sending it back as you have then accepted the responsibility - Car Phone Warehouse need to sort the problem out. Your contract is with CPW not the manufacturers. Go in store, wait until there as many customers in store and then kick up a fuss. Alternatively you could do what I had to do once and that was stage a sit in (not CPW but another store) - the store threatened to call the police to have me forcibly removed, I said go ahead it is not a problem, I have just phoned my husband to ask the local press to attend, I hope your store likes the publicity. Within half an hour I had got my money back. I must have been feeling brave that day :)

i seriously wish you the BEST OF LUCK!!

i bought my nexus 2012 from them when it first came out
broke after 2 months of use
took it back they said they don't exchange as its out of the 28 days and that it'd have to be sent off
they sent it to THEIR repair centre
came back FAULTY
sent it off again
came back faulty, i had only had it for 2 months, by now the sending and coming back had taken 2 motnhs
i got seriously fed up and filed off a complain to the CEO

i got a NEW nexus2012 sent out to me, however as it was xmas, and the tablet had only just been released they struggled to trck one down for me, but the team kept me informed
