Long stort sort of short
We own a 1940s house
Major belly in the main sewer just down the road from us
On the odd occasion a few of us need our drains rodding
We have never rodded it and have lived here since 1991
If its needed doing southern water orca contractor do it
The drain in question is 80cm onto our driveway
Approx 9 or 10 years ago southern water broke part of the interceptor leading to the mains
Its never caused a problem until recently when the mains block in the road due to this belly in the pipe
We even had a camera put down our pipes and no faults found as we wondered if our pipe had colapsed
Southern water cut back maintaining the mains and now residents drains are backing up they agree to come out more regular
Today i check the drain and its started to block again
Called southern water and they come out whilst im at work and my partners home
The idiot rodded with whatever and went through the pipe into earth i suppose
His rod came out with clay on the end
He called for a bigger machine to clear and jet it
The guys doing it told my partner we are responsible as its on our property
Remember they have maintained it due to this belly for at least 25 years
On inspection tonight my interceptor is totally destroyed
Looking down the pipe if they have gone through its off my property and under a footpath next to the road
So who is liable
Any advice appreciated for the phone call to southern water tomorrow
I dont feel i should pay for it as they broke it and have no idea of cost involved

Speak to Southern Water to resolve it.

I don't understand how you can be liable because if you were then you should've been told in the first place when they first came out to rod it and you would've had to pay to have it rodded.

Any neighbours drains linked to yours on your property? If so, then they are responsible for the shared part of the underground drainage on your property

No neighbours linked to our drain
We don't get charged for it being rodded due to the belly in the mains

Hopefully, you will get this sorted with Southern Water. You seem to know all the facts and no doubt have lots of documentation. The fact that neighbours suffer similarly is in your favour.
The guy who did the rodding on your property appears to have acted without authorisation either by you or his company - that might be a good place to start as you seem to be alleging this act was the cause of the current problem. The fact that rodding has never taken place before suggests to me that is because of some potential risk in doing so. Is this risk well known and documented? Is it a risk any "reasonable" operative should have been competent to appreciate.
Ultimately you may need a solicitor if Southern water dont see sense. You should be able to find one who specialises in this sort of thing from the law society web site or give Citizens Advice a call.

Southern water sent a contractor out to rod the drain and he couldn't clear it
Chocci , the edge of my drain and interceptor are 80cm onto my property
When the rod the drain the rod leaves my property to underneath a public footpath and the road
The break in the pipe is off my property and under the public footpath
I've raised a complaint with southern water as the contractor hasn't completed his log of work to my property
I've told them exactly what's happened also and am awaiting a call back

You need it looked at by the southern water inspectors. If your not happy then complain to the top. Bump up to the presidents office at southern water... If your still not happy then your local mp and council. Mother in law got the council involved in her drain problem. She don't know what they discussed between them when they all turned up to discuss it. She stayed away but was ready to give them stick, but it was sorted out, A man hole was put outside her house in the road where a pipe was rising up a little causing a blockage. The regular cleaning was not working. She thinks the council man batted for her.

in that case, southern water are entirely responsible for the repair as the break is not on your property

Does not surprise me a mod altered my post , happens quite a lot
Must give then some sence of achievement nobody knows about
Spoke to southern water today , they are going to camera my drains again to see what the guy has done
They will only repair the damage past my boundary and nothing damaged by them on my property
Bit of a joke really but I'll take legal advice and put a claim in
The pipe having the camera will happen in about 3 weeks so in the meantime I'll contaminate the ground
I'm tempted to ring my local council and get them involved as southern water seem to want to pass the blame onto me
But they will clear my drain every time its blocked in the meantime
Was hoping for them to cover the cost of the interceptor and won't do anything until a camera has been down it

I phoned Severn trent about our drain and they have a 3 day policy. That turned up next day with camera

Southern water accepted liability and have replaced my interceptor
They checked all the details in the letter I wrote and confirmed they had damaged it
They literally concreted the hole a few days ago
No hassle and happy with the outcome
Glad they take pics on each visit to confirm everything
Result
