Hi all,

So I have a friend who signed up for a fairly ordinary EE mobile Sim only plan (12mths, 1gb, 1000mins, Unltd texts £11.99). It's been 27 hours since he left the high street shop and it's still not working, customer service keep fobbing him off telling him to wait a bit longer.

This sim is a replacement as the old EE sim was lost, but that sim was pay as you go. So there's a phone number wanting to be retained in the mix.

I would like to know if it's possible to rescind this contract without penalty, get a PAC code and move to a different provider? I understand there's no cooling-off period for high street shops (?) but is there a case as this sim is not functioning?

What does everyone think?

*Sorry, as others have said - this 14 day law is to cover all online purchases

I had the same problem, but mine was a monthly contract sim. I had nothing for 3 days. Went into an EE shop and they did some manual reset on their systems for the sim or number, not sure which. Within the hour I had it all up and running properly.

Some mixed messages here!

Assuming no cooling off period, any chance of terminating as there has been no service provided?

You will be able to cancel if you don't get any connection but wait as the shop said. It took nearly two days for a sim replacement from ee to activate for me when i had others before it took about an hour. It can take a few days to activate a replacement sim if the number has to come over.

Legally correct, but it appears that EE have a 14 day return even if purchased in store.

Although they state they don't offer returns for change of mind, only if you're "not happy with the coverage".....

You do get a cooling off period I store. It might not be 14 days it could be 7 but you do get a cooling off period because you are signing a credit agreement.

Nope. Cooling off period covers "change of mind" - that isn't offered instore. They only offer returns for coverage issues:

We do not offer a change of mind policy in stores, however, if you’re a new or upgraded customer and are experiencing coverage issues or our coverage does not meet your expectation, you can return within first 14 days of entering into a contract. You can only make one return within this time. Use our EE store finder.

However, it's always worth a try. We bought a phone which turned out to not really be fit for what we wanted it for - it was probably my fault as I should have researched it better, but the store were still willing to swap it after a couple of days.
