Car finance trouble with the car

Bought a car on finance from Evan Halshaws (first mistake) and 3-4 weeks into owning it I gave them a list of problems I wanted sorting as the gear box was terrible at switching gear, Low mpg and other problems. They took the car back for 16 days and when it came back it was no different to before it went!!!!
Long story short, I notified trading standards and my finance company and eventually they sent out an assessor that identified problems with the car. A long battle with Evans and they agreed to replace the car for something else...that was 3 months ago. They dont reply to phone calls or emails and I am at the end of my tether with it all.
Can I tell my finance company that I wont make another payment until this is sorted out or will it just impact my credit rating? I dont know any other option. Has anyone been in the same boat and what outcome did you get?

Suggest you phone the finance company and discuss it with them....and also perhaps speak to your local CAB

The assessor agreed there was problems with the car but couldn't say they were present at the time of purchase. This gave me 2 options, have the car repaired again or chose another car. If I could I would drive to Evans and throw them the keys back!!!

I presume the finance is on a Hire Purchase agreement? if so then its up to the finance company to sort it all out as effectively they own the car until you've paid all the payments.

Get in touch with the finance company and explain everything, tell them you no longer want the car due to faults and that you want to cancel the finance. I wouldn't bother calling the garage themselves anymore just deal with your finance company.

I'd fight for a full refund if I was you. Probably too late now. As WTP says though, you should never of agreed to a replacement car

Although I would agree to what you are saying, in this situation the comment does not help him at all.
If I were in OP's shoes, I would have posted this question also in MSE (money saving expert) and perhaps on which? where you are mostly likely to get some useful advice.

as they took the car back for 16 days so soon after you bought it, it's clear the faults were there from the start

That's so irresponsible, how about contacting TSA and pursuing with them? Have you thought about taking a legal route?

they probably feel as so much time has now passed you've accepted the car

Just obtained a copy of the assessors report showing the faults I had stated! Next move would be legal advice I guess. Didn't really want to take it that far but I don't really have a choice. Thanks guys for your comments

I am so dissatisfied with the service of Evan Halshaws that I will be making an appointment with my local cab. I have given you 3 months to find me a suitable car and you are ducking me at every turn. The car you sold me is NOT suitable for purchase and I will go see these guys to tell me what my next cause of action will be. I will print off the initial appointments I made to Evans back in the first week of January (3 weeks after buying the car from you at Batley) and the email communication between us to see if I can get this matter sorted out in a timely manner. You have my number if you want to discuss this with me but in all honestly Jon, I have been treated so badly by your company that I wouldn't trust a word you said or any promises that you make.
The only outcome I am wanting now is a full refund so I can take my custom elsewhere to a company that offers a better customer service than the one you provided.

Who is the finance company? and was it a hire purchase agreement?

If you are serious about look into the Consumer Credit Act.

There is a section which covers HP and returning goods. Is you finance with MotoNovo? if so it is on the back of their annual statement, it only mentions it briefly but it gives you the section number of the CCA where it is covered.

I had a friend which a very similar thing happened and he exercised his right to give up the goods and cease payments. As far as i can remember it has no negative impact on his credit rating, which i couldnt understand why?

Had a problem with Evans heals haw recently re repairs , return and then refund of money being paid back to me . After a bit of agro with telephoned calls I Asked to speak to the dealer principle and insist on meeting in main showroom , kept cool and assertive , eventually got refund and some compensation.

I spoke with the dealer principle yesterday as the guy dealing with this matter has "left the company" Had a long conversation with him yesterday and he seems to want to get it sorted so we will see.
