Hi, need some help please.

Bought a cheap nokia phone from ebay. Seller sent the phone using Hermes delivery. The day it was suppose to deliver i was away. I checked the tracking and it said. Delivered through letterbox. Checked the post box and surrounding. Nothing found. Contacted Hermes they said they cant disclose details more than what it says on tracking i have to involve sender. Now ebay seller has got something serious going on in her life and cant chase the delivery company. I asked ebay to step in and ebay closed the case in seller favor saying as item marked as delivered so they wont do anything more unless i have written confirmation from delivery company.
What are my options here any suggestion .

I believe that they should have your signature if they say that it was delivered. As you didn't sign it - they will try to ignore you I believe. Tell them that they didn't deliver it and you report it to the police. This is the easiest option I guess.

Contact ebay cs and appeal by phone. They'll get someone to contact Hermes, Hermes cant prove beyond doubt delivery if not signed for.

I had something like this once.
I went through paypal and paypal said they would help if I reported this as a crime.
So, for a £40 item I went to police station and had a recorded interview for about 3 minutes, got a crime reference number on headed paper, scanned it, uploaded to paypal and they refunded me.

Do you have exclusive access to the delivery letterbox? Are there other letterboxes adjacent / near to yours / could possibly be mistaken as yours?

get the police/bank involved

That's the annoying thing about Hermes, the tracking quite often says item delivered via letterbox when there's no way said item would fit through a letterbox.

Was the phone boxed OP,would it even fit through a letterbox?

What would Paypal do in this instance if it says delivered though?

Hermes dont require a signature, unless youve paid extra for it. They do get you to sign for it if you're there for delivery, although its not a requirement.

the sender needs to prove that you signed something.

As far as I'm aware that's changed, they just require proof of delivery.
