I recently purchased a game from this deal

Received the item today and it was in poor condition, the casing had dents and scratches all over. The manuals were ripped and the Disk has minor scratches.

Even though all of these are cosmetic flaws, it shouldn't be classed as "NEW", sticking a security seal on a used game doesn't make it "new" right?

Has anyone had this similar situation before with Game? What should I do? (I broke off the seal)

Right. GAME use display cases when they run out of sealed cases. These display cases are ones that have been instore and obviously are unsealed. They keep the new manual and disc separate and just take the display case of the shelf and insert the contents and they need to seal it so use their own purple sticker. This isn't common but it isn't rare either, it's always happened. Fortunately I've never had this happen and I've ordered a lot of stuff. The game is new though and not used, Ideally it should be sold as "Like New" or something similar just to let customers know it isn't sealed. If the only options are Preowned or New though then New is the right option as the game hasn't been owned or used before. You can return the item though as long as it's sealed if you're unhappy with it.

Anyway the case being damaged is just due to it being a display copy, it's unfortunate though yes. What is concerning though in your situation is your manual and disc being damaged which isn't common. This could just be a used item getting mixed with new but it is unfortunate but it does count as a faulty item and from experience they will let you return it if you want to. As you've said though, you contacted them and you can return it.

Have a look on ypur invoice. Does it say new or mint?

Game arr doing this all the time now. All the ones i have had have been in great condition though havent been sealed. Discs in pristine condition and club nintendo card was present. They appear to be shelf copies / display copies.

You can take it back to any store but since you have broken the seal im not sure if a refund can be done. It is a con as they are listed as 'new' on the web site but come as 'mint' on the invoice, which technically not what you ordered.

I dont think its been used. The case was on the shelf instore. Ive had sealed games with minor scratches and maybe the staff werent careful enough handling it

Just take it back and demand a refund or replacement. It doesn't matter if you broke the seal.

They put mint on receipts for sealed items too, doesnt mean anything.

If it says new on the website, but invoice says mint, it is a breach of Sales of Goods Act. You are therefore entitled to a refund or replacement with a new copy.

If it says as new or mint and arrived in the condition you specify, it is not as described and therefore are still entitled to a refund or replacement.

Such refunds must include any postage charge for return as the product is not as sold, therefore you are not accountable.

It's a common thing with Game. Report them to Trading Standards.

They arent deceiving you it isnt used, it just got beat up abit.

Yes I know what you mean, the Disk it self might be New and the casing and manual may have been damaged due to the reasons you stated above. However the disk has clear signs of usage also the manual was ripped as well. But I guarantee that this game has been played on by another person.

All Game did was stick their own security seal onto a USED game and sold it on as NEW.

They've done this for years!
Probably had 3 games supposedly new, but with clearly used discs (I'm not talking the light scratches a disc might get when staff have put it in the box) and manuals with pages stuck together from fizzy drinks.

See here from 2011.
Game deny it, but one of the commenters admits to doing it while working there.

In fairness, I'd consider yourself lucky you even had a disc in the case, as I've them turn out to be empty before :p

Update. My copy wasnt factory sealed but box, disc, manual all in new condition. Box sealed with games own seal. Luck of the draw. Ive not had a bad one yet.

Sorry if this has been discussed previously , never purchased anything online from Game before. But the game i received could easily pass off as a used item. So I was the unlucky one who received a display case and a used Manual :(. Thanks for the information, I don't think I will be buying anything from Game anytime soon.

Sooo Game unseals the factory seal and replaces it with there own purple seal to prevent people from returning it once opened?

Don't worry it's fine :) for what it's worth, you won't always get an unsealed copy. I never have and I order a lot fromgame. It's not a common thing, especially getting a used copy like you did.

On your second point. GAME unseal some games for in store to use the boxes to display on shelfand put the disc and manual in a sleeve. When they run out of factory sealed copies they'll use the display copy boxes and seal them with a purple sticker so it can be returned if needed. When online run out of an item they'll sometimes bring some in from stores to sell. When stock is really low these will sometimes be the unsealed display copies.

It should yes you're right, The Game Collection do this and so should game. I do think that if it's out of new or Preowned though then New fits it better. The item hasn't ever been owned or used by anyone else.
