Hi people, I needed some advice about eBay. On the 12th October I bidded and won some prada sunglasses for my partner to gift. They were under the `used' but in the description it stated the box had a mark on but the sun glasses had no marks on. When they arrived I noticed 3 deep noticeable scratches I took pictures and immediately messaged seller as I was sending via mobile phone She was not receiving them finally a few days later I managed to send via laptop she said she would send her brother the pictures as she was selling for him and he was sure there was no scratches on them as he cleaned them before sending (they were dirty when they arrive so not sure what he cleaned) she asked if I wanted to return I said yes as I paid £82.50 plus £5.50 postage! I sent back second class recorded delivery and on Friday there had arrived as I was checking on royal mail tracker and somebody signed for them. I messaged her to ask has she received after two messages she replied saying she does not know as she is on holiday till monday. So today I emailed her she replied saying i am back in the evening I will message you tmrw. I don't know if she is going to message me or make a excuse. I have never been in a situation like this I think she will make a excuse tmrw. What can I do what if she says she didt receive and she doesn't know who signed for them. Sending them. Cost me £3.95 so altogether has cost me £91.95.

Any advice on what I can do

If you paid via PayPal open a dispute now

Put in a ebay claim as not described and update with tracking info, you will win the case

contact EBay via their help page , file a claim and do same if you paid by PayPal

you shouldn't have to pay for returns regardless if the item is not as described or damaged . you should have opened a return through eBay resolution center. if she accepts the return on those grounds she will then be forced to provide you with a tracked postage label. then once you send it and it is tracked as delivered eBay will automatically refund you .
as you have done this separate of the resolution center it may be best to call eBay and explain the situation I have always found them very polite and helpful on the phone .
or you could try and open a return now and if she accepts enter your tracking number . this will force her to refund you if it's tracked as delivered to that eBay members eBay registered address.
if a return is not accepted by the seller eBay will step in and make a decision and if you have photo evidence of damage this will almost certainly be decided in your favour.

When you put in a claim and you provide ebay with a ref number for the return they will track it and will be aware that the goods have been received. I am pretty sure it will then go into your favour as you will have proof that they were returned and signed for. Ebay do not usually go chasing to see if someone else signed for it etc, all they are interested in is that someone signed for it and it has been delivered. The seller will have to prove it is not them which will make it harder for them to do this.


You should have requested a claim to return the goods first and return it when ebay ask you too, providing your ef number. When you put your claim through ebay will ask for this on the second stage.

ebay not paypal and always remember if this happens again even if seller wants to accept it start a return item request through ebay and state not as described as reason. Going through ebay from start is always easiest.

Thank you for Your reply, I should have contacted eBay first I thought it would be straightforward with the seller that I would send back and she would refund me. If this happens again I will definitely contact eBay first. Just rang eBay and a very helpful lady has filed a claim and she said I will be refunded by next week.

Thank you for your reply, I have just rang ebay they said they will make sure I am refunded by next week. Next time if anything like this happens I will definitely contact ebay first

​thats crap I have feedback of over 1800 100% trustworthy. when I say without faults in perfect condition, it is!

The OP has called Ebay already.

Just a point to note in your post, the postage receipt isn't enough. You need tracking showing the return. If the OP had opened a case on Ebay, a label would have been provided for them to return the item.

The OP has called Ebay already.
Just a point to note in your post, the postage receipt isn't enough. You need tracking showing the return. If the OP had opened a case on Ebay, a label would have been provided for them to return the item.

I only read the original description.

They stated that someone has already signed for the parcel, hence my comment.
