Placed a 3 upgrade in store yesterday for the note 7 and was told i could collect on 30th of august. Well today, i got a phone call saying that it will be 13th September for pick up as there have been too many orders for the coral blue colour. I asked if i could reverse the upgrade or cancel before 13th September (as i wanted to see if i could find a better deal) and they said if you place the upgrade in store you cannot.

It says this on the website:

You can do a one time “like for like” exchange within 7 days from the day you received your device, as long as it’s in as new condition.

I rung the store up and told them that it says within 7 days of receiving device which i have still not received and the upgrade has not kicked in yet. He said he will speak with the area manager and get back to me.

So are you still on your existing contract? if so i dont see anything they can do. if they argue cant you just cancel your contract?

yes still on existing contract.

legally you have no additional rights to cancel above the consumer contracts regulations (i.e replaced sales of goods act). As you were in store, the 14 day cooling off period does not apply. However, you may be able to argue that as the terms of sale changed (i.e later pickup than original) you may be able to cancel. I'd wait to see what they come back with.

Go into the store and speak with them in person, state you you wish to cancel as the terms of the contract have changed; the date has changed.

you formed a contract, an agreement between you and the store. You may have signed something which may have contained T&Cs. These T&Cs cannot in themselves be illegal - they cannot contradict UK Law, From what you say you were given a date. That date has been withdrawn - the contract therefore is null and void. You just need to go physically back to the shop to sort the paperwork out. Take a packed meal with and make sure they realise that you are prepared to stay in the shop until all is sorted - ask them if you can use their toilet.
