Refund on car to debit card

I purchased a second hand car for my son from a main dealer , long story short it was a dodo !! Anyway waited for v5 -and as agreed returned car for a full refund . I paid on my debit card , they stated they could not refund to same debit card but would do a bank transfer or a cheque , I opted for bank transfer , said would take 3 to 5 working days , not had cash go into account and it's 5 full day tommorow , what are my rights . Is this classed as theft ??? Going tommorow after work ,

If it's a main dealer I think you don't have much of a problem.

Go to see them be polite and see what's the hold up. It's not time to burn them down yet.

I'm waiting till 4pm tommorow going to double check bank then go to dealer , just
Wanted any advice , frustrated by this as they got car and money , I am going to sit in till get cash I think ?

there are two different types of law (that's a generalisation but adequate for these purposes)

for example if I slapped you in the street and stole your wallet, that's a crime, it's criminal and will be investigated by police and CPS.
if I agreed to fix your porch, then 6 months later, you discovered the workmanship was shoddy, that's a civil matter - a breach of contract which can still be enforced by the courts leading to financial awards, but not a criminal record.
there are times when negligence or fraud regarding something generally civil can become criminal e.g. if I took a grand off you to fix the porch then ran off to spain with it

don't let them mug you off. sometimes these things can be authorised quickly, especially in a smaller organisation with less red tape. they might just be difficult to fob you off. has it been 5 days including weekends or 5 working days?

I'd be wanting to know exactly why they can't simply refund the bank card you bought it on. That's the usual method of refund for card transactions. Sellers ask for the exact card used for purchase. Check with your bank for advice before you go back to garage.

I'm absolutely fantastic, what i'm trying to say is allow the full 5 working days for the funds to be transferred back to you before thinking of small claims or the Mounted Police.

If it's a main dealer I think you don't have much of a problem.

No one here has mentioned that if your debit card carries the VISA logo, then you have quite a bit of redress thru your bank.

So, if it is a Visa debit card then contact your bank, and ask them to arrange a chargeback - obviously you will need to explain the situation, but if the dealer has accepted the car back, then you should have no problem.

Thank you , I went to dealership this pm , very apologetic , have reassured me il get payment first thing in morning , I said about card debit payment and manager couldn't give me an explanation for not being refunded by card . I obviously will be checking with bank , but hopefully dealt with it . Thank you to all of you for perspectives and info on this . Cheers , fingers crossed !

Companies that regularly take large payments on cards use a different bank account to manage the funds, it makes things easier when it comes to book keeping, and the accounts are usually linked to high interest rates so they can earn money on deposits and such, so it is not unusual for a dealer to be unable to refund from this account. However, dealers also hate refunding, so it doesn't shock me they have taken their time, same thing has happened to me, they wanted to do a bank transfer and it took weeks and loads of emails, hopefully they will sort it for you this time.
