Will eBay side with me on this case?

Hi,

Okay I will try to make this quick, short and detailed as possible.

Bought an LG G3 phone for my mother for Christmas, received it on 19th, and opened it to make sure that the item condition and camera, wifi, signal etc works.

So i did a quick over and was pretty much happy except that it was on 5.0 instead of 6.0 which LG G3s received the update for, but I didnt really mind since its for my 50 year old mother, she wont know the difference.

So i messaged him saying exactly this: everything seems to be working fine, but why isnt there a 6.0 update?

(Mind I have not left feedback, as for all my Christmas presents I wait until they have been opened and played around extensively)

Fast forward to Christmas day my mother opens the present, chuffed, turns it on and after a while realise there is a yellow smudge on the digitizer in the right top corner, its not very noticeable but its there especially when theres a white background, hmm that was not stated in the description.

Then I charge the phone and the wire keeps coming loose everytime you move the phone an inch while charging.

I message him, and he states you must have dropped it or damaged it while wrapping it up, I deny that is the case.

He now states that he has spoken to eBay and since I sent a message saying 'everything seems to be working perfectly' and therefor I was happy, they will side with him.

eBay will make a final decision on the 2nd of January on the case.

So what is the likelyhood of me winning the case?, I have provided pictures of the yellow smudge to eBay, although its as noticeable in pictures and I am not sure there is a way of showing the loose charging port?

I also like to state I bought another LG G3 from another seller at the same time, for my father, and that was perfect and I left positive feedback for him once my father opened it on Christmas.

short answer: ebay will side with you, that's exactly why you are given a period of time to open the case....it gives you chance to examine it.

long answer: "everything seems to be working fine" is not a definitive "I'm happy with everything". I have known cases to be opened AND be successful long after positive feedback has been left. Some problems with items don't present themselves initially, and that's why ebay (and paypal) give you time to open a dispute. Don't worry, youll be fine. Just make sure you stick to the facts in the case and keep it simple ready for an ebay team member to read and make a decision.

if you brought with paypal you have a buyers gaurantee i think its for like 500pounds.i would almost be certain that you will get your money back here.just might take a little time

You should be fine. Dispute resolution is pretty heavy weighted to the buyer. Your item is not as described and therefore you should get a pretty quick decision. You will need to return it once they make their decision, make sure you send it via a tracked method - myhermes/parcel2go are likely your cheapest options, don't use RM recorded. You need tracking that EBay can use to confirm it has been returned. You will most likely be liable for the return postage however if you paid using PayPal then they currently have an offer on that will cover you up to £15 to return items. Google the PayPal offer since you need to activate the deal, for some reason it is not automatic.

Actually, I think you'll find in "item not as described / damaged" cases, ebay (via the seller) will foot the return postage bill and give you a label to print. its only in "I don't want it anymore (buyers remorse)" cases that the buyer will pay for return postage.

logically, why would you be made to pay return postage when the seller didn't describe it properly?

had this happen to me ebay will definitely side with u I still lost tho as I got no refund for posting back loss of 7 quid that made me :(

Google oleophonic screen marks on images. See if the smudge looks like some of those photos. People comments have been they've had phones only few weeks and this happened . "due to some oleophobic residue from the manufacturing process. If it's just on the glass, then you're right, it shouldn't affect performance."
And therefore nothing to do with how you've handled phone but due to the phone manufacturing process.
If so use this info for eBay/ seller

2nd hand or new? most phones i've had a year or 2 suffer from screen burn in. Have you tried another usb cable?

If it's a yellow smudge, that will be most likely down to pressure rather than screen burn. If it's all round then burn. I see pressure marks like this day in day out on iPhones but also Samsung whether it's pressure from dropping or tight cars to bad screens / replacement jobs

well, the seller's attitude is wrong, eBay will not even look close at such a cases and while you open return request as item faulty or not as described - it will process through in your favour ;)

thank you all for your quick responses, I spoke to eBay and they said like pashapav said that they will not make a decision nor imply any bias towards a case.
So i think he either lied by saying he rang up or lied by selling me that agreed with him.

Anyway I took pics and uploaded them towards my case, and also uploaded a youtube video of the issue with the charging cable. I used it in the device, and showed how easy it was to fall out by a simple touch, and also showed using the exact same cable in another android device to show it was due to the LG G3 that the charging cable doesn't stay in.

again thanks for your quick responses, I was sure eBay would agree with me, but since the seller stated he spoke to them and they said he was in the right, got a bit scared.

The OP has stated they never leave feedback until purchase has been 'played around with extensively'.

Sounds like the seller is either attempting to fob you off or is genuinely of the opinion that eBay would side with him.

eBay have the ability to view messages between buyer/seller and 'may' see the one you sent where you stated everything was working perfectly, BUT I agree with others, they will take your side, as the faults you describe wouldn't be noticed immediately.

you'll be fine. You are not happy with it, it's obvious it isn't working as intended.

Did you make sure to put in all the details into the case messages, such as the charger cable falling out if slightly moved?

Good luck fam, seller probably knew of the issues.

eBay sided on my side, as everyone stated, so I sent the item back special next day delivery, and I checked the tracking details and it states the seller refused to accept delivery and it's being returned to sender (me)

I will ring eBay when I.get off work but what is going to happen now?

yep, spoke to eBay, they refunded me, and i asked them what to do with the phone that i have received back, they said its nothing to do with ebBay, you have to work that out with the seller.

Seller hasn't messaged me yet, so dont know if he hasnt noticed that the money has been taken out of his account to refund me or if ebay have refunded me out of their own pocket?

eBay has taken the money from the seller. It's your prerogative on how you wish to proceed.
