Terms and conditions of participation for voters
The application and selection process will be conducted by SWISS International Air Lines (hereinafter referred to as “SWISS”).
Wherever the masculine form is used in the following, this is meant to include the feminine form too.
For valid participation in the application and selection process, the participant must have registered via the form at the microsite (www.theswissexplorer.com). The closing date for registration is Wednesday, 28 May 2014 at 12.00 noon Central European Time.
Participation in the application and selection process is free of charge and independent of any purchase or the utilisation of any services subject to a charge.
Adult citizens of Switzerland or the European Union without criminal records are entitled to participate in the application and selection process.
Each person may participate in the application process on one occasion only. By way of his participation in the application process, the participant declares his acceptance of the rules of the application process.
2. SWISS Explorer application process
The application and selection process for the SWISS Explorer job comprises 4 phases. All 4 phases must be completed successfully and the contract of employment offered by SWISS to the winner of the fourth phase accepted in order for the applicant concerned to be appointed to the position of “The SWISS Explorer”. The application and selection process is explained in detail in the following.
Phase 1: Open application
Each applicant uploads his application documents on to the microsite (www.theswissexplorer.com). The upload process defined on the microsite (www.theswissexplorer.com) applies. A full application comprises a current “selfie” (self-portrait photo), an application letter, a current curriculum vitae, references from a report on the best travel/holiday experience the applicant has had as well as a video portrait of the applicant’s qualifications detailing his suitability for the position as SWISS Explorer.
The applications submitted will be examined and assessed by a jury. The judging process will be conducted behind closed doors in early June 2014. 7 candidates will be invited to a second application phase.
Additionally, 3 further candidates for the second application phase will be determined by way of public voting via an individual Facebook login. The winners of the public voting are those 3 candidates receiving the most votes for their video portrait on the microsite (www.theswissexplorer.com). Within the framework of the voting process in application phase 1, the submission of multiple votes is possible, but no more than 1 vote per applicant. The voting process will end on 1 June 2014 at 12.00 midnight Central European Time.
Phase 2: Application interviews round 1
The candidates for phase 2 determined in phase 1 will be invited to an assessment day. Each candidate will be offered two dates for the assessment day. If an applicant is unable to attend on either of the dates proposed, replacement candidates will be nominated. If an applicant nominated by the jury in phase 1 is affected by this, a further applicant nominated by the jury will take his place. If a candidate selected via public voting is affected by this, the candidate with the next-highest number of votes will take his place. The judging process will be conducted behind closed doors in early June 2014.
The applicants invited will be interviewed by SWISS and will be given problems to solve. The jury then selects 3 to 5 candidates to attend a further round of interviews. The selection process will be conducted behind closed doors in the first half of June 2014.
Phase 3: Application interviews round 2
The 3 to 5 candidates selected from phase 2 will each be invited to a further application interview.
Once the 2nd round of interviews has been completed, the internal SWISS jury selects the candidates (provisionally 3, subject to change) for the final application round. Prior fundamental agreement on a contract of employment must be reached between SWISS and the potential finalist before the candidate can move on to application phase 4. The selection process and the contractual negotiations will be conducted behind closed doors in the second half of June 2014.
Phase 4: Final selection process
The finalists selected in phase 3 will then fly to a destination stipulated by SWISS, where they will be given a task to perform and will then report on this in their capacity as potential SWISS Explorer. If a finalist selected is unable to attend the final session, the jury reserves the right to nominate behind closed doors a further applicant from phase 3 to replace the finalist concerned.
The reports on the finalists’ experiences will be published on the microsite (www.theswissexplorer.com).provisionally on 23 June 2014 and the public asked to vote on them. The final voting process will end on 30 June 2014 at 9.00 a.m. Central European Time. In the voting process of application phase 4, voters from phase 1 may also vote again but as before only on a 1-vote-per-applicant basis. The candidate whose work result receives the most votes on the microsite (www.theswissexplorer.com) is considered to have won the final pubic voting. The appointment as SWISS Explorer will only be valid, however, if the contract of employment defined in phase 3 is signed by the winner.
The candidate appointed as SWISS Explorer will be announced officially in early July 2014.
3. Recruitment professionals
Recruitment professionals are not allowed to participate in the application and selection process.
4. Data protection
The protection of your personal data is of particular importance to SWISS. We would therefore like to inform you about our data protection principles with which SWISS undertakes to comply in order to ensure that the application and selection process you participate in is conducted in a trusting and confidential manner.
a. Correctness of data
Participants must ensure that all their particulars are correct, complete and truthful. You are herewith informed that deliberately incorrect or misleading statements or information in your application, at interviews or during assessment may lead to the rejection of your application or, in the event of you already being employed at SWISS, may have consequences for you under labour law.
b. Data usage
The information you convey to SWISS by way of your application, either verbally or in writing, during or in connection with the recruitment process as well as during assessments or interviews will be kept on file by SWISS.
Your data will be used for the following purposes: (i) recruitment, (ii) advertising purposes in connection with the recruitment process, (iii) statistics, (iv) personnel administration and (v) management purposes.
c. Data security
Neither SWISS nor any service provider guarantees that data transmitted electronically cannot be viewed by third parties or lost. Further, SWISS and its service providers reject any liability in this respect.
d. Submission of film, image or sound material for application and selection process
By way of the participation of the person concerned in the application and selection process and acceptance of these terms and conditions, the participant confirms that the film, image or sound material submitted does not violate any third party rights (notably intellectual property and personal rights). In the event that the image or sound material violates third party rights with SWISS thereby suffering harm, SWISS is entitled to assert claims for compensation.
e. Publication of the material submitted on the Internet, in print media, on TV or via other communication channels
The participants declare themselves to be in agreement that SWISS has the usage and exploitation rights to the film, image and sound material submitted without any place- or time-related limitations. SWISS is thus entitled to freely dispose of the film, image and sound material submitted by participants to the jury competition without any additional remuneration being due.
The applicants declare themselves to be in agreement that the film, image and sound material be published for viewing via the online archive at www.swiss.com, other communication channels as well as reporting conducted with the media partners. The applicant’s first name, last name, place and country of residence may also be published via the above-mentioned channels.
f. SWISS internal usage of material submitted for application and selection process
Access to the data you submit, the usage of which is not otherwise specified under 4.e, is limited to such persons as are directly involved with your application. This refers to those persons who process your application and those who are appointed to conduct personnel selection duties.
Your data will be made accessible to the department inviting applications for the position concerned as well as to the relevant Human Resources unit.
SWISS may also forward your data to such third parties (service providers) which may be located outside your country of residence. The third parties concerned are carrying out duties on behalf of SWISS. Any third parties acting by order of SWISS must however meet optimum standards of security to ensure that the protection of your data is guaranteed in accordance with these terms and conditions.
5. Disqualification from participation
SWISS is entitled to exclude individual participants from the application and selection process if justified reasons such as the violation of the terms and conditions of participation, the influencing of the voting competition, manipulation, etc. exist. Such applicants will moreover be excluded as submit offensive or legally non-compliant material for the application process.
6. Right of appeal / Applicable law / Place of jurisdiction
There will be no written correspondence concerning the application process and the selection of the SWISS Explorer. The jury’s verdict is final. No entitlement to employment can be legally asserted. Swiss law applies exclusively. The exclusive place of jurisdiction is Kloten, Switzerland.
7. Amendment of the rules of participation and termination of the competition
SWISS reserves the right to amend the terms and conditions of application, selection and participation, etc. at any time. SWISS moreover reserves the right to terminate or interrupt the application and selection process at any time. This applies notably if such reasons exist as would disrupt or prevent the scheduled course of the application and selection process.
8. Prize draw for vouchers in connection with public voting in application phase 1
By way of casting their vote, voters participate automatically in a prize draw for 10 x 2 vouchers for SWISS Europe flights (Economy Class, excluding charter flights) and automatically accept the terms and conditions of participation mentioned here. The chances of winning are independent of the number of votes cast. Votes can be cast up until 1 June 2014 at 12.00 midnight Central European Time. The winners will be notified by e-mail. There will be no written correspondence concerning the jury competition; the jury’s verdict is final; the prizes cannot be converted into cash.
9. Prize draw for vouchers in connection with public voting in application phase 4
By way of casting their vote, voters participate automatically in a prize draw for 10 x 2 vouchers for SWISS Europe flights (Economy Class, excluding charter flights) and automatically accept the terms and conditions of participation mentioned here. Here too, the chances of winning are independent of the number of votes cast. Votes can be cast up until 30 June 2014 at 09.00 a.m. Central European Time. The winners will be notified by e-mail. There will be no written correspondence concerning the jury competition; the jury’s verdict is final; the prizes cannot be converted into cash.
10. Determination of the winners
The prizes won by way of the two voting processes will be drawn in accordance with the principle of random selection. The prize draw will take place behind closed doors in early July 2014.
The winners must confirm their acceptance of the prize within 30 days via the e-mail address stated on the letter of notification sent out to the winners, otherwise their claim to the prize lapses without any compensation.
11. Despatch of prize
The prize is sent exclusively to the winners. The prize is awarded exclusively in the stated form as a voucher; it cannot be swapped or paid out in cash. Upon confirmation of acceptance by the winners, the prizes will be sent automatically by SWISS to the address indicated. The risk connected with the prize in voucher form is herewith transferred to the winners. Any tax due on the prize is the responsibility of the winners themselves. Flight vouchers cannot be used by third parties, assigned to them or sold and are only redeemable for flights operated by SWISS (excluding charter flights for which no flight vouchers can be redeemed). A firm booking can be made in the seat class allocated subject to availability. No miles can be collected for this. The validity cannot be extended.
12. Limitation of liability
Insofar as this is allowed by law, no liability whatsoever is assumed by SWISS.
13. Severability clause
Should individual provisions set out in the terms and conditions of participation be invalid or unenforceable, the validity of the other provisions remains unaffected by this. The invalid or unenforceable provisions are to be replaced by such valid and enforceable provisions as come closest to the original ones in terms of achieving the objective pursued by SWISS. In the event that there is a discrepancy between the German, French and English versions of these terms and conditions of participation, the German version is deemed to be definitive.
