A1. The Serious Cycle Scheme is operated by Serious Law LLP. Legal expenses insurance cover for cycle accident claims will be provided to members of the scheme, up to an indemnity limit of £150,000, when a personal injury claim with reasonable prospects of success is accepted and pursued by Serious Law LLP.
A2. Serious Law LLP, in their sole discretion, will assess whether your claim possesses reasonable prospects of success. In making this assessment, Serious Law LLP will take into account, amongst other things:-
i. that at the inception and throughout your claim, it is more likely than not that you will recover in full from your opponent your damages and legal costs;
ii. that throughout your claim, your opponent is insured and likely to be able to pay your damages and legal costs referred to in A2 (ii) in full.
A3. Serious Law LLP retain, in their absolute discretion, the right to dismiss a member from the scheme and/or withdraw or cancel insurance cover and/or the membership of any member, at any time whatsoever.
B1. The prize draw (the "Prize Draw") is open to people who join the Serious Cycle Scheme and provide their correct email address.
B2. Employees or agencies of Serious Law LLP or their family members, or anyone else connected with the Prize Draw may not enter the Prize Draw.
B3. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
B4. By submitting your personal information you agree to receive emails from Serious Law LLP containing offers and developments that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.
B5. Only one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
B6. Serious Law LLP accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by Serious Law LLP.
B7. The closing date of the Prize Draw is 23:59 on 7th July 2017. Entries received outside this time period will not be considered.
B8. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process. The draw will take place in week commencing 8th July 2017.
B9. The winner will receive the prize of a GoPro Hero Session Action Camcorder (subject to para B.11 and B.13).
B10. Serious Law LLP accepts no responsibility for any costs associated with the prize.
B11. The winner will be notified by email during the week commencing 8th July 2017 and must agree with Serious Law LLP a time, date and location within the Greater Manchester area, to take delivery of the prize. Serious Law LLP accepts no responsibility if any email notifying the winner is lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.
B12. The winner will be announced by email in the week commencing 8th June 2017 and consents to their name being publicised in this respect.
B13. If a winner does not respond to Serious Law LLP, in accordance with para B.11, within 14 days of being notified by Serious Law LLP, then the winner's prize will be forfeited and Serious Law LLP shall be entitled to select another winner in accordance with the process described in para B.8 above (and that winner will have to respond to notification of their win within 14 days or else they will also forfeit their prize). If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner's prize will be forfeited and Serious Law LLP shall be entitled to select another winner.
B14. The prize will be delivered to the winner by Serious Law LLP to a location within the Greater Manchester area, by prior arrangement in accordance with para B.11.
B15. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
B16. Serious Law LLP retain the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.
B17. The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on Serious Law LLP’s reasonable request. The winner consents to the use by Serious Law LLP and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner's voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by Serious Law LLP and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.
B19. Serious Law LLP accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. Serious Law LLP further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw.
B20. Serious Law LLP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of Serious Law LLP in all matters under its control is final and binding and no correspondence will be entered into.
B21. Serious Law LLP shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
B22. The Prize Draw will be governed by English law and entrants to the Prize Draw submit to the exclusive jurisdiction of the English courts.
