For the avoidance of doubt, Brian May does not, and none of his related companies, have any role in the Competition. 1.3. You can enter the Competition via our website at (the "Website"). 1.4. For all queries or issues with the Competition, please email: [email protected] 2. WHAT TERMS, CONDITIONS AND RULES APPLY TO THE COMPETITION? 2.1. These terms and conditions ("Terms") apply to the Competition. Any persons who breach them may be excluded from access to the Competition. 2.2. Instructions about how to enter the Competition appear on the flysheets of the book entitled “Brian May’s Red Special” (“Book”) and those instructions form part of these Terms. 2.3. The following general terms also apply to the Competition: (a) entries are restricted to one entry per person; (b) entries must be received between 11:59pm GMT on 30 September 2014 and midnight GMT on 28 February 2015 (the "Competition Period"). Any entries received before or after this period will not be entered; (c) if you are under 18, you must have the consent of your parents or legal guardian to take part in the Competition; and (d) employees of Carlton (and their family members) or any company involved in the Competition are excluded from entering and any entry will not be considered. 2.4. In the event of any fault, misunderstanding, mistake or dispute concerning the operation of the Competition, including the correctness or acceptability of any answers given by a Winner (as defined in Term 4), or the operation of any technical/communications system, our decision shall be final. 3. HOW DO I ENTER THE COMPETITION? 3.1. To enter the Competition you must: (a) register free of charge (no purchase of the Book is necessary) on the Website by entering your name, email address, address, phone number, and country of residence; and (b) correctly answer the multiple choice question asked on the Website (“Question”). 3.2. Answers which purport to give the answer using any other method or language will not be accepted. 4. WINNER SELECTION A single winner will be selected at random from: 4.1. all entrants resident in the UK (“UK Winner”); and 4.2. all other entrants (“International Winner”), who have correctly answered the Question in the manner we require in the Competition Period, under the supervision of an independent overseer (together the "Winners" and each a “Winner”). 5. PRIZE 5.1. The prize for the Competition is replica of Brian May’s famous guitar known as “Red Special”, signed by Brian May ("Prize"). There is one Prize for each Winner. 5.2. We will notify the Winners by email no later than 5:30pm GMT on 31 March 2015 (“Announcement Date”). 5.3. The Winners’ names and country of residence, and the correct answer to the Question, will be announced on the Website at the same time as the Winners are notified. 5.4. If no entrant from the UK and/or no entrant from outside the UK submits the correct answer, an announcement saying so will be made on the Website on the Announcement Date, together with the correct answer to the Question. 5.5. Each Prize will be made available to its Winner no later than the Announcement Date. 5.6. The Winners must collect or arrange for the collection of their Prize from us at the address in Term 1.1 above. 5.7. We will not be liable if a Prize fails to reach a Winner, or a Winner cannot take a Prize, or delivery of a Prize is delayed. 5.8. No alternative prizes will be given and each Prize is non-transferable and non-exchangeable. 5.9. It is the responsibility of the Winner to pay any and all applicable taxes on their Prize. 5.10. We reserve the right to verify the Winner's eligibility and to verify to our satisfaction his or her identity. Failure to provide proof of identity satisfactory to us within a reasonable period of our request shall entitle us to delay the award of the Prize or disqualify that Winner from the Competition and select another UK Winner or International Winner (as the case may be) to receive their Prize. All personal details and information must be truthful and accurate. 5.11. We reserve the right to disqualify any person from the Competition and/or withdraw any Prize should they at any stage supply any untruthful, inaccurate or misleading personal details and information. 6. WHAT IF MY ENTRY IS LOST OR DAMAGED? If we do not receive an entry from you for the Competition then we cannot enter you, regardless of whether you submitted the entry to us. Also, if we receive an entry from you that is incomplete or otherwise deficient, for example an answer that does not comply with the method set out in Term 3.1 above, we may not be able to enter you. We will not accept proof that an entry was entered as proof that we received it. 7. HOW FAR ARE WE LIABLE OR RESPONSIBLE TO YOU? 7.1. Nothing in these Terms removes or limits our liability for fraud, death or personal injury caused by our negligence or for any liability that cannot be limited or excluded by the law. These Terms also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the Competition. 7.2. We will also not be liable to any person for financial loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, postal services, software providers and telephone traffic handlers. 8. CONFIDENTIALITY 8.1. You undertake not at any time to disclose, reveal, communicate or otherwise make public any confidential information relating to Carlton, its business, personnel, servants, agents or officers or to anyone. 8.2. You hereby agree that you shall not divulge to any party, any trade secret, confidential information, or generally any information concerning the business or finances of Carlton, or any of their dealings, transactions or affairs of which you shall come to know unless required by law or unless such information is already in the public domain. In addition, you agree and acknowledge that you shall not (except as required by law or unless such information is already in the public domain) at any time hereafter, either personally, or by means of press or publicity or advertising agencies, divulge or disclose any information of any nature or kind relating to the development or production of the Competition, or make any statement or announcement or disclosure, or supply any information or photographs, to any person or to the public, relating to any matter arising hereunder, coming within your knowledge by reason of your participation in the Competition. 9. HOW WILL WE USE YOUR PERSONAL DETAILS? 9.1. Carlton will use your personal information for the purpose of: (a) operating the Competition and processing your Competition entry; and (b) posting your name and country on the Website should you win the Competition; and (c) dealing with any enquiries or complaints. 9.2. Where we want to use your personal details for purposes other than those in Term 9.1 above (such as publicity surrounding the Competition) we will offer you the opportunity to agree or to refuse this. 9.3. Your personal information will be treated in accordance with our privacy policy from time to time (the policy as at the date in Term 11 below appears after these Terms) and in accordance with the law of the UK as it relates to people’s personal information. 10. THE LEGAL POSITION OF THESE TERMS AND CONDITIONS 10.1. These Terms form a legally binding agreement between you and us. We reserve the right to change them and update them from time to time but if we do so we will post the changes on the Website. 10.2. These Terms shall be governed by English and Welsh law and are subject to the exclusive jurisdiction of the courts of London, United Kingdom. 11. This privacy policy (the "Privacy Policy") sets out how any information, including personal information, that we collect from you or that you provide to us will be collected and used. If you don't agree to it and don't want to be bound by it, then you won't be able to receive information from us relating to further competitions.
