Inorder of rapid fire a chip has to be inserted into the controller, so does count as a modded peice of hardware.
You don't normally get banned - if you use these. Play on-line, theres so many people clearly using them. What does happen, is the game restricts you, to how many bullets you can fire - so if you press the fire button, 100 times a second (which is impossible by a human hand) using one of these pads, the game ignores all these extra presses - most games are happy to allow 7-8 button presses a second. This happens locally, before the information even reaches xbox live - try playing off line, you can see the rate of fire being restriced.
This is why, this pad, lets you program the speed of your rapid fire, to match the game you are playing! Go on the http://www.codejunkies.com website, you can do all this and even re-allocate other buttons etc..., its not just a rapid fire pad - does more.

I'm amazed he hasn't been banned. The record is about 10mins of someone using one. Have to keep an eye on that
