From an old HUKD post - http://www.hotukdeals.com/misc/selling-out-date-food-legal-936965

Foods Standards Agency

Is it legal to sell products past their 'best before' date?
Shops are allowed to sell food after its 'best before' date has passed. 'best before' dates are concerned with quality rather than safety, so it doesn't mean that the food is dangerous if the 'best before' date has passed. However, if you buy food after the date, remember that it might no longer be at its best.

'Use by' dates are different to 'best before' dates and it is against the law to sell any food that has passed its 'use by' date. Using it after this date could put your health at risk.

In all cases, whether or not the 'best before' date has expired, the law says that food sold must not put people's health at risk and must not be falsely or misleadingly described or presented.

Best Before is OK to sell past the date, Use By isnt

'Best Before' and 'Use By' are 2 completely different things. Ive seen things in B&M before past their best before date and been told by the manager they are allowed to sell things 30 days past the best before date. They just reduce the cost a lot, and normally mark them as short dated or whatever.

You only have to look at things like eggs on a supermarket shelf, the best before and use by date is about 2-3 weeks apart. Makes for a bargain for perfectly good food.

we all know the difference between best before, and out of date. these don't say best before? we can assume they may be, but are not 100% sure. I stand by my original comment that it is illegal to sell " out of date" food

Indeed I do, but what makes it soft if it isn't moisture?

are they allowed to sell out of date chocolate? I found out of date chocolates at Tesco and asked them to discount them and they told me they are not allowed to sell them

Stock up for truck or treaters at the end of the month!
#27
To put everyone's mind at ease they are BEST BEFORE END August 2016, for 25p I'd eat last years. Won't bother me!
Having worked in retail you can sell
Out of date items; however it has to state BBE end and not use by, also we used to state that it was past it's best before end date also!

I'd love to stock up on these, but as with most the 'killer' bargains listed at B&M, no sign of them in my local store. Best of luck!

I thought the same when I see them on here, depending where I do my shop there's 3 to choose from. Still rarely find bargains!

Best before dates are for things like chocolate and other long life products that wont be harmful after that date but might not be as good.

Use by dates are for things like meat products which can be harmful shortly after their dates.
