A contract has been formed for the Phillips T2040

You should write back and demand to receive the product that you ordered. If they're unable to provide you with it, ask for compensation up to the value of cost of purchasing it elsewhere (loss of a bargain)

Blast for once I didn't think of that, too late already arranged a collection to return them, plus they gave me £25 to spend on account.

Is the £25 in addition to the refund?

The £25 is compensation in addition to the full refund.

£25 compensation is what I would have expected so that's a good result.

Did you have to ask for it, or did they just offer it to you?

Robot, originally I asked that they supply me with the correct item but after the CS rep did his best to find me something it turned out that they had none due to a stocking error on the order code. So I stated that I will source it elsewhere and will seek some form of compensation in lieu of the error and inconvenience caused, to which he kindly offered me the £25. Couldn't ask fairer than that.

My order is due to turn up on Tuesday. I purchased two, one for myself and one for a mate.

I found the item page - http://webcache.googleusercontent.com/search?q=cache:H8RDKYr9zgoJ:www.marksandspencer.com/Philips-TT2040-Bodygroom-Ultimate-Bodygroomer/dp/B00479QEH8&cd=1&hl=en&ct=clnk&gl=uk and have saved a copy to my PC just to prove the item description. I'm looking forward to seeing what their response will be

your receipt should say it all, from I gather the CS rep was fully aware of the problem. I can't see there being any stocks but if you speak with CS on the phone you'll bound to get something as a sorry, in store I am not so sure.

Received hairdryers today as was predicted, I spoke to CS and they wouldn't offer any sort of compensation, but just an apology and they even wanted me to go to the post office or store to return it.

I've just emailed CS and stated my rights under 'loss of a bargain' and I'm awaiting their reponse

CS were not helpful at all and offered me a £5 gift voucher.

I've now sent a letter threatening to pursue this case at the Small Claims do not provide damages which is the difference between this and the price at Amazon

Quick update....

After sending them a letter threatening to take legal action, I've received an apology letter from them and a cheque for the full damages claimed.

£53 plus a full refund

I bought 2 so they paid damages for both

great result, a new advert appeared the other day so I ordered a couple again to see if they come this time. Nothing is on the site now but I pick up tomorrow so fingers crossed I have the right items this time, if not they can collect again and hopefully make good on the error..once again.
