Taz, how is wickjnr crying? It's perfectly understandable to expect or deserve some form of confirmation that your supposed item has been cancelled.

Anyway, I've just sent them an angry e-mail. Not that I expect or a reply or for anything to be done about it but its common practice for Zavvi to do it and I just needed to vent some frustration their way.

    :{

Why does everyone act as if it's their god given right to have these prices honored?

Seeing as you seen a bit of an idiot, I'll explain things a little clearer to you.

I don't really have much of an issue with them not honoring the deal, but I'm surprised that they think its good business practice to cancel a customers order without telling them.

    a) it was obvious what was going to happen b) cancellation emails ARE being sent out c) no payment was taken

I didn't receive any sort of discount with my cancellation email, didn't expect to either.

I have not got anything either, just a straightforward cancellation.

For those interested now they have cancelled. All the £369 orders there seems to be stock available to preorder at £469. Not for the bargain hunters, more those who desire a day one console and don't have a better preorder...

Just had mine cancelled. Knew I shouldn't have used my 10% voucher as well BOOOOO

Was tempted to find a voucher in my emails, but figured they always have terms stating it's not to be used with hardware so never bothered.

the 10% did track thats what worried me most. a complete error on their part. ive emailed to complain. pretty pointless really. i dont know why i bother with zavvi. i remember ordering pirates of the carribean 1-4 blu ray when it dropped to 9.99 i used a %20 voucher they sent me and they cancelled my order saying no stock but it was still for sale for 9.99 lol ridick

Doesn't say day 1 stock anymore. Would be a risk.

Ahh, I didn't see that! I ordered earlier in the end :-) thx for pointing out.

Even though you know they will be cancelled when ordering, it's still a disappointment when it happens. My amazon pre order is £429 so it's not out the realms of possibility it would have been honoured (especially as it was only live for the briefest amount of time)

I've seen much more outrageous pricing errors honoured in the past, but then again this is Zavvi, not even a discount voucher included :) I know they owe us nothing, but this sort of practice only discourages and puts people off from ordering in the future.

Nowhere near the level of service you'd get from somewhere like Amazon, which I can't praise enough.

And Viking Direct Christmas Day 2008. If anyone remembers they had a £300+ laptop for sale for £199 with no link to live stock levels so only the first few received it. However they honoured their mistake and sourced £300+ Fujitsu Siemens laptops for the rest of us for £199 as replacements and threw in a £20 voucher just to say sorry. Now that's customer service.

Sold out now, seems people snapped them up even at the inflated price.

Can we trust zavvi on this?? I am not convinced.

Your question should have stopped at "Zavvi". The answer is no.

I had an email saying "was this what you were looking for?" with a link to the £470 bundle.

Ummm no, I wanted the hot deal thank you very much...!

A small piece of legislation called the Sale of Goods Act 1979. Specifically section 13.

They'll use an exclusion clause to get around it and limit liability, but products should be sold as described, according to the legislation. I realise that this won't be, but that is why people believe that it should be sent. If the shoe was on the other foot, the company would claim that the consumer agreed to it, and therefore was contracted to make payment in full.

The product is as described. It's the price that was wrong.

No contract was formed, so time to move on.

Pathetic you are not entitled to a misprice

Lol. Everyones a part time solicitor on this forum. A contract isn't formed until they have dispatched the goods. The price on the website is an invitation to shop and as I said before the contract isn't formed until they dispatch the goods.

I'm gutted they didn't honour this deal but it was a clear misprice. I'm more annoyed that they cancelled without notifying me as to why, even though I know the answer.
A courtesy email to admit they made a mistake and that they were sorry for wasting our time would have been appropriate.
