While these are excellent drives, I have indeed heard a few negative comments regarding using them in nas boxes.
I went for two 2tb samsungs instead.
Yep, so if you use TCB or Quidco you get about a quid back.
The Acronis software that you can download after purchasing this is really good for cloning a failing drive.
I really do wish that hard drives were more reliable. They just get cheaper and cheaper instead of better and better. Finger out please manufacturers.
wd has 2 years warranty..amazon says 3 but why?

All these manufacturers create drives which are more reliable. You don't have buy the cheapest!
For example, some manufacturers call them 'enterprise', some specify that they are suitable for 24/7 use etc.
For an example, look into the Seagate ST32000645NS.

Seagate now has 2-3 year Warrentys. I just bought 1 x 3TB and 2 x 2 TB Seagate drives and all of them have over 2 years worth of warrenty, expiring Novemember 2014.
Western Digital has 2 year warrentys now, Seagate also has 2 year warrentys, Neither has a better warranty period.
2TB Segate - £67 - 2 Year Warrenty, much better deal.
This deal is cold.

1 year, 2 years, Lifetime warranties? None of which are a scrap of use when you've lost your data. It's reliability we need for our precious 0's and 1's not a warranty.

Since I was specifically referring to the HD204UI which was many people's drive of choice prior to the Seagate's purchase of the Samsung HDD division, I'm not sure why our "friend" was getting so excited. As the warranty went from three years to one that became an important buying consideration, especially during the price highs as a result of the Thai floods. As prices are now steadily dropping and the HD204UI is being phased out it's worth checking out what is available. If you like WD then this is a decent deal.
Of course if you are not backing up a warranty of any length is somewhat moot.
I would still choose WD over Seagate in both cases. As for your theoretical question, well it depends on the level of 'fail', I don't know what the stats are on drives that completely stop working with little or no warning. I'd suggest in most instances there is an indication, at least for the technically minded, that something is up, meaning the said files can be move/erased prior to being RMA'd.
