Its free you didn't buy the laptop. You bought the phone contract. Simple.

I bought a DS off here this week, I fixed it, the fix hasn't cost me anything in parts but has cost me solder and my own time (Crap soldering iron). I can't sell it on for more its classed as profiteering.

You have the right to sell elsewhere just not here.

Some places don't mind profiteering or where you got it from. Ebay for one.

Might be an idea to point some out so you can help the mods out and clear up these profitering mongrels.

these rules are getting stupid. A lot of people get an upgrade phone then sell them on, or get a free games console.

This is the rule under which i have broken
(10) You must NOT list items for sale at higher than the recommended retail price. The marker of RRP will be determined by cross indexing with Amazon or other well known retailer. Profiteering is NOT permitted and this includes items previously found at a lower price in the 'Deals' or ANY forum here.
* Vouchers available as non transferable or with next to no resale value, such as 0.001p for example and generally available free items etc. must NOT be offered for sale or trade.

I agree with Adam why not tell HDUK to stuff their FT/FS rules and sell somewhere else? because you'd probably have to pay?

It sounds harsh but Admin is doing members a favour by letting them sell on here..........people seem to think its a fundamental right.......

EDIT - BTW did you ever cough-up the £10 for that last to post thread?

Collectables can also not be sold. That should be added to the rules, they closed mine down during the week.

Technically yes.

See you bought contract, and didn't upgrade your phone.

You bought the contract and received a free laptop?

They bought the contract and paid for the phone in the contract.

Its the mods discretion at the end of the day. I personally have no problem with selling stuff at a profit if your using your brain.

But the rules are there if the mods think thats its wrong they will look. Anything classed as a freebie in there eyes is locked.

You have the right to report other threads if you are unclear.

I think the rules are getting tighter, but thats because there old and flawed. Given time I hope the admin staff will enlarge the rules and make them more fair and clear.

It's free to sell stuff on here..... can't see why people complain about the rules, as it's not like you've been left out of pocket if your thread gets locked.

Everyone knows that but some of the rules have become so stupid ... Selling something you got for free e,g. things off freecycle or freebies from companies, but why can't you sell your phone, that you have paid for within your contract. The phone isn't exactly free as you need to take out the contract to get it, same thing as getting laptop with the contract

tara1082, as pointed out above the mobile phone contract covers the cost of the mobile line agreement & the mobile phone etc - the laptop came 'free' as an incentive with that mobile phone contract. Therefore the laptop cannot be resold under the profiteering rules.

It covers the cost of the laptop, the phone is also an incentive so to speak. They could choose a phone or a laptop, therefore they are classed as the same.

you are not allowed to sell free upgrades, the phone is as free as the laptop is, you are paying for the line rental, not the phone or laptop

every phone on here(almost) is a contract phone, dont see why that cant be classed as profiteering? I've sold my contract phones on before

Not with every contract Sassie, thats not true.

I paid £100 for an upgrade on my iphone.

£200 if I wanted the better version.

I agree the phone rule needs to be clear. Or have its own rules.

but the same thing is for mobiles with contracts and loads of them are sold here.

I previously asked if I could sell my 16GB iPod touch, which I got free with my iPhone £45pm contract. I was told it was fine... But lets be honest here. None of us are that stupid that we actually believe that phone companies give things away for free, right?:whistling:

Utter rubbish. Mods and admin need to make the rules more clear. I could have had a phone but said i wanted a laptop instead as i already had a phone which i liked. I was offered the laptop instead of the phone.

What about if you have a free upgrade, but then decide to sell your old handset? Shouldn't that be seen as profiteering as the old handset would have been a freebie from your previous 12/18/24-month contract ?

Then I expect you to clear out all mobile phones for sale in the FS section, because you know as well as the next person, the mobile phone was free...... unless of course the member can prove otherwise.

Thats not true though is it. It may be described as 'free' but invariably the line rental is available for significantly less, on a rolling-month 'sim-only' contract with nearly all the mobile phone companies now which pretty much rules out that argument.

This rule is getting a bit silly now as people are being punished for being honest. A large number of phones sold on here are those supplied as part of a contract deal - it seems the case that if you are honest and say that you will get the thread locked, if you say nothing you won't - and that doesn't really make much sense... :thumbsup:

depending on what price you pay for your contract dictates what mobile you will get for free....

if i pay 45 quid a month i may get an iphone 3gs which i can sell on here for say £400

if i pay 45 quid a month and take a crap nokia 1100 worth a tenner but i get a laptop as well as part of the deal

what happens with the above scenarios then please mods is there a difference and are we eligible to sell any of the items as they are free

The contract covers the cost of the line agreement and laptop. How is it any different to selling a phone that is part of a contract?

The laptop is not FREE and its not PROFITEERING. The contract covers the cost of the laptop and the line rental. Basically people are now being punished for misleading terminology from the contract sellers - if the laptop hadn't been (inaccurately) described as free by the company it wouldn't be an issue.

It was actually reviewed by the Admin Team prior to locking - Moderator's normally clarify the rules when we receive a report on threads such as these prior to taking any action - tara1082s been given the relevant information & the correct follow up links via PM if they want to discuss the matter further regarding their specific case.

exactly, a gift, you dont pay for a gift it is given free, hence the profiteering, i dont agree with most of the rules on here but can see where they come from
