Hi r3tract,
First of all, I am going to move this over to feedback (rather than misc). I think that you raise a good point that I would rather see discussed sensibly, rather than it potentially wander off topic and get lost in misc.
Secondly, as you are probably aware, I am first and foremost a 'deals' moderator and this subject is clearly about FS. For that reason, although I suspect the answer, I am not going to pass comment and instead I am going to draw this threads attention to the moderators who are 'FS mods' (rather than post something that may be incorrect, and then be 'quoted' on it).
As all sensible mods are now fast asleep, don't expect an immediate response; but you will get one

The iPhone Bumper case has a retail price of £0.00, hence you can only give it away for free.

There is reason to the madness, most of the times. ;)

Generally bundled items can be split, however the bottom line is that they cannot be sold above RRP.

If you got it for free and no longer have the phone give it away with postage being covered. Think the arguement about buying a £500 phone is very flawed. Like saying I could sell my bogoff item (second one) because I paid for the other half, either way you look it I would be profiteering.

You could sell BOGOF's here, just not both of them for a combined sale price higher than the original purchase price paid.

No, I'm saying you could sell one at the full purchase price paid and keep the other. However if you sold the remaining item later at 1p or above, then you'd be profiteering.

That is true in the case of the Official Apple Bumper, as it will continue to be free for the forseeable future! As for the other cases, they do have a RRP and can be bought outside of the free case programme so I think it is these cases that I particularly refer to!

Yes, I agree, as for example, if someone bought a console with games that were included (outside of the console box itself (i.e they had a RRP)) then it would be perfectly within the rules to sell those games on here, in fact it happens frequently. So I would see the reselling of a case from the programme, bar the Bumper Case, as the same thing and well within the rules.

What is the bottom line then aSB? Is it Ok to sell them or not?

Didn't know that about Bogoffs. Fair enough but still looks profittering to me. Anyway I think the Op will know what point i'm getting at I hope (he's usually great at these things).

I do understand where your coming from Adam, but see my post a couple up regarding the example of a console bundled with regular retail games, (not the ones without a barcode), do you still think, if you sold the console - and assuming you aren't profiteering when you split the bundle - would you give away the games for free?

Okay Josh, games and Free bumper cases are a little diferrent in that there is no RRP, if you are now saying cases in general its a different matter.

It does seem a little unfair if someone bought (for real money) a third party iPhone case which was later included in the 'free' cover-up-our-cockup-giveaway, would then not be allowed to sell the case for less than they paid, particularly if said case is still available in retail channels at a set price.

I don't the mods have a problem with that if proof of purchase (receipt can be proven) But in all likelyness if that was the case people are going to buy the item anyway as they can order it free with a phone call ( so Im told)

If the actual item on offer has an RRP and available to buy then it can be resold for an amount not greater than the purchase price paid or rrp (whichever is lower).

If it cannot be purchased separately then the answer is NO.



How the item came into a members possession is not really an issue now (unless it's stolen goods or business related).

That's profiteering. You buy 2 for £10, and then sell one for £10. You are a £10 item to the good.

As above, we can't force a value on the item that is held back by the member. However should it then be listed at 1p or above, that's profiteering. It's not really a major issue and if one or two did slip through the net then they would more than likely be picked up as a result of bulk selling and restrictions applied.
