iPod Shuffle arrived in a terrible state, cracked and unbelievable filthy... after a slow transaction of PM's seller is refusing to take any responsibility or assist in any way so have reported matter to mods.

Sellers and Buyers have a duty to ensure that goods are as described. If the shuffle contains a crack that was not described at point of sale and/or this has happened in transit, they should arrange to ensure the buyer is happy with the transaction.

It's the sellers responsibility to ensure goods get to the buyer in the condition as described.

OP - Do let us have a response and inform us how you aim to remedy the situation.

The item is in excellent working order and what I consider to be in good condition. There was no crack that I was aware of as I had used it for evryday use. The buyer did not request any further information or photos before purchassing the ipod which I would have happily provided. As i said there is nothing wrong with the ipod and the buyer has even said it works perfectly.

I will post some photos of the item on Tuesday (it's at my office) but as you can tell I'm far from happy and the condition is shocking, can't believe someone would sell something like it and NOT mention what terrible shape it's in.

It's easy to see the condition is far from what could be expected without saying anything in the original sales post. Cracked, dented and completely filthy. I'm far from happy and although this is only a £15 item it's down right unacceptable to sell something in this condition and NOT state this clearly in the topic.

I have requested a return address and a refund and unless the seller is willing to offer a compromise of sorts then this is still what I'm seeking.

Request final update from OP in response to above. The condition certainly appears not as described however please respond if you think this is an issue with the 'courier' or you have another valid reason for your misdescription.

I believe that the buyer is trying to send back a different ipod and keep my one. Mod if you can assist. I am an honest seller and am not going to give a refund for something I didn't sell.

Sorry to say that Amy is lying, that was indeed the shuffle that arrived with me and I expressed this to her the as soon as it was received (proof of PM's available). How she can say the damage is not visible in her posted image is laughable, the Shuffle is so small and in it's box in the picture you can't see anything (not to mention it's blurry!!)

Going to come to down to my word against theres I'm afraid. I can 100% swear on my little baby boys life that is the Shuffle that Amy has sent out. I do not posses another 1G Shuffle hence buying this one.

All this for the sake of £15 is silly, issue a refund I shall return your Shuffle and we can all move on.

It might help if you send me the serial number (identification mark) that uniquely identifies your shuffle, then perhaps I can assist in drawing this to a conclusion.

I don't have the number. Its not something I would write down and keep. But this is definalty not the one I sent. The picture i posted may not be close up but you can see that its not damaged and is pure white.

Here are some pictures I took earlier today at about the same distance and angle as yours, sadly I couldn't get it it as blurry as you:

Do you have the original full size image from the one you've posted? Perhaps if you'd care to zoom in you would be able to see the dent and also see the serial number.

This is SO the iPod Shuffle you have passed off as being fine and has arrived cracked, dented and filthy.

Amy, its clear to me that you are having some sort of difficulty accepting the truth in this matter and continue to deny any responsibility for what you have sent. If you are unable to come to terms with supplying an item like this in such a bad state then perhaps the money is worryingly important to you, after all £15 may mean a lot to some folk.

It is also clear to me that this is unlikely to get resolved, Amy you are being completely unreasonable and unhelpful. I have remained polite and friendly throughout all of this and at every point, Amy, you have been short, rude and downright unhelpful. Maybe you has issues of some sort but this is a sad state of affairs over £15.


I won't hold my breath for a reply but do hope that at some point your conscience will finally get the better of you and you admit your error and put things right.[/SIZE]

(13) Goods remain the responsibility of the seller until the buyer takes possession and affirms they are okay. For this reason be honest in your descriptions and include original photos so the buyer knows what they are getting!


missposty, failure to resolve this matter & reach a mutually satisfactory should be reflected in your sales feedback from this thread. It would be better to arrange an agreement re a refund if both parties have reached a deadlock over the condition of the items. And Jonmurgie, feedback should reflect your honest view of the trade and issues that were raised and how they were addressed. Hopefully this can still be resolved 9this should be done off thread & directly between the two parties), and if not then please leave the relevant feedback, thank you.
