Hi everyone

I'm selling my PlayStation 3 along with all the games and accessories I have for it as I'd like to buy a Xbox 360 again. The console is a couple of months old and originally had an 80GB hard drive in it which I replaced with a 320GB hard drive. The 320GB hard drive is a Toshiba from the same model range as the 80GB hard drive which I will include for the buyer. The console also comes with in all as new/excellent condition:

Far Cry 2
SingStar Vol. 2
SingStar Vol. 3
Midnight Club: Los Angeles
FIFA 09
Mirror's Edge
Enemy Territory: Quake Wars
Saint's Row 2
Gioteck EX-01 Bluetooth Headset
2 SingStar microphones (these came in a pack with SingStar Vol. 2)

£320 is the price I'm looking for which include delivery costs (£300 collection in person but I'm willing to consider sensible offers of which the first that can be agreed by both parties will be the winning offer. I will not send first to make this clear from the offset. I accept payment first which upon receipt the items will be sent immediately by courier or Royal Mail Special Delivery. I prefer collection in person above all.

What condition is the 360 in? Any damage (i.e. dropped, smoke-free home, pets, physical, ventilation etc.)?

Is in absolutely fantastic condition mate, as good as new. Never been dropped, has no damage, no scratches, never dropped. Smoke free home, no pets!

Is well ventilated, in absolute tip top condition. Given date of manufacture still within warranty, and well within 3 RROD warranty.

How about yours? Same?

Same villan, I always look after stuff I buy (keep boxes and manuals, keep charged up, etc.) I'd rather no split frollicking as it wouldn't really be worth it and it would detract from the value of the whole package. Thanks for your interest though!

Could you leave it all set up so can check working, will set the 360 up at yours so you can check that also.

The rules do not state that you have to sell or trade to any particular person, morally I suppose you should go through with it, but again nothing in the rule book that says you have to.

I'd personally be interested in finding out why this deal never went through as I am interested in doing a trade for the PS3 myself, but will see what is said from here....

FULFILLING YOUR TRADE OBLIGATIONS
(12) Once an offer has been made and accepted the trade should be considered final. Sellers who accept an offer and subsequently accept a higher offer from another member may be banned from trading. On the flip side members who submit an offer and subsequently cannot fulfil it due to lack of funds will be banned from trading.

Mate, after someone accepts an offer all details exchanged, arrangements made, you can't pull out. As per miniOne's post above. You should be 100% sure that you are happy with the deal before wasting anyones time. The mods have also confirmed that the guy shouldn't have pulled out, and in my opinion he should be banned.

I have to say it is my opinion that the guy pulled out as a direct consequence of what you offered, as I know that he wants a 120GB hard drive cos he told me!

I'm not 100% impressed with your involvement in this, as i think the guy got his head turned by the 3 week old elite! In my opinion you shouldn't have posted as the deal was done and there was no point in you posting what you did. If the deal had fallen through, then you should have posted. No point crying over spilt milk, but I do think you were out of order. If the boot was on the other foot i'm sure you would feel the same.

But we've dealt before and i'm sure we will again, this trade has just been one of those things! Disappointed but c'est la vie!

Of course you can, what a stupid statement. Its not a legally binding contract, just a gentelmens agreement to go ahead with what has been agreed. I do agree with you though that if all details have been exchanged then its a little out of order to back out UNLESS a good reason can be given.

As for your remarks regarding "my involvment", I simply mentioned that I was interested in a trade if the deal with you were to fall through, it happens on here and on plenty of other forums, so cannot see what your problem is. You cant blame me for the wrong doings of the OP, when as we have both agreed he SHOULD have completed the trade.

The fact of the matter is that the OP has not contacted me regarding a trade, so see your accusations as being unfounded to say the least.

Lets swap this round,

PS3 game up for trade, you offer x ps3 game in trade, seller accepts, details swapped, all done.

2 hours late I come in, offer 2 ps3 games to him, he goes, deal with Simon_G off!

Would you be happy??? You don't need to reply, we all know the answer!

Anyway, as I said, no hard feelings, just one of those things. I now draw a line under it (but feel free to reply if you want, love a good debate (particularly when i'm right!))

I think the OP got his head turned by Si's offer.

I have been given no explanation by the OP as to why the deal is off, given we have discussed the trade at length last night via PM and by text message I can only look at the facts in front of me.

The fact is, all was good until a further message came saying "if deal goes belly up, i'll trade my 360 with you". Sadly for me Si's was probs a better deal than mine, and I consider that if he hadn't posted, the deal would still be on!

Anyway, life goes on, I already have a PS3, this was for the spare room so no real harm done. Just a stickler for the rules!

are you sure about that? you will be surprised some of the things people sue other people over, I have seen pettier reasons than this go through the courts.. I reckon if Vilan wanted to pursue and had proof of agreement they would have a decent case.

My sincerest apologies for what's happened, it wasn't Simon's offer that caused me to back out...I just got cold feet about the actual trade and decided that I no longer wanted to go ahead with it. I'm sorry for wasting villan's time and if I've broken one of the rules.

You are right Jough, there is clear offer and acceptance, therefore a contract between Neo and myself has been formed, and subsequently broken by Neo. This would be water tight if I wanted to go to Court, however it's not worth the time and expense.
