  Actually, i was waiting for the pictures he was going to post of the damage, guess forum etiquette doesnt mean a lot after all.

  The seller can sell to WHOEVER they like. There is no such thing as 1st, 2nd, 3rd refusal so it's pointless bickering about it. Make your offer in thread, the OP should then accept an offer they want to in thread. Tough luck to anyone who isn't chosen.
