How am i meant to get a refund off a seller? "AllYouEverNeed" Even paypal agree i should have one

I bought this gameboy off AllYouEverNeed before christmas, i even paid him extra to send it recorded.

I still havent recieved my gameboy and lets say he hasent been very helpful either, he has refused to give me a refund even though i paid for recorded.

I raised the dispute with paypal who

" We have decided in your favour, however, we were unable to recover any
funds from the seller's account."

So even paypal agree with me that he should refund me, but seeing as he doesnt have any funds in his paypal account they cannot.

Does anyone have a clue what i should do? I know its not a lot of money but that isnt the point, i paid for something and i expect to either receive that item or have a refund.

The bloke has took the mickey all this time and now im fed up with it, i cant even PM him any more because his PM BOX is full up.

i'd threaten small claims court, and see if that has any effect.

ultimately, if all of your contact attempts are ignored, you may just have to chalk this up to experience.

I know its a silly question but did/does he have a confirmed account? I only ask because I brought something last year from Germany and the man ran off with all the money - he'd conned other people too BUT as he had a confirmed account (and so do I) Paypal paid me the money themselves. This probably doesn't help, sorry.

Would the small claims court work? I cant do that, i dont have his address.

Right, tip to people, never ever buy something without knowing their address.

I emailed him saying if he thinks he is in the right then put a reply on this thread.

I didnt think it would get any replys in that part of the forum, its why i put it in there.

Like if you want something its beter to put it in here than in deal requests.

If he is saying Royal Mail have lost it you should be able to claim off them if the seller will give you the tracking number.

Excuse TheSaint, he can be a little rash with his comments at times.

It hurts me to say this (:)) but he does have a point. If you never got the sellers address or contact details (as per the forum tips at the top of every page) then I guess you only have yourself to blame.

In regards to your original question, even though paypal have agreed with you, if there is no money in the sellers account there is little you can do to be fair.

Personally, I'd put this down to experience, a harsh and costly one, but experience none the less.

Out of interest, did you ask for feedback elsewhere, did you ask or see any pictures of the items etc? What did you do to protect yourself?

(I'm not having a go, just asking a question here)

boothy, it wasnt through ebay, was through here.

Simon, there were pictures of the item etc on the post on the forum.

And i have the tracking number for it, but i thought only the sender could claim? Which is why im annoyed that he hasent.

Paypal only agree with the buyer if the seller cannot provide a tracking number, it's not about who's right or wrong it's a simple tracking number? No! seller loses.

He could claim from the royal mail and if he won't then it means he never sent in the first place.

You have lost your money, move on, but learn from this.

If the item has not been delivered, and the seller has taken your money, I would bet that he has claimed the compensation for himself and not returned it to you.

Again, put it down to experience and make sure you learn from it.

Looks like he has been using multiple use names and has had a 10 day ban before....you need to contact a mod to alert them

I'd like to disagree with that comment if I may? I have asked ebayer sellers to claim for items not delivered to me in the past and i have NEVER been contacted by the Post Office, yet the money was refunded to the seller and subsequently passed on to me.

It does happen rarely simon ...I have had it twice in about 2 years,but have reported a lot more than that missing.

Most times that the above happens you will find the ebay seller hasn't posted the item in the first place. Post very very rarely goes missing. I have had 1 item in 5 years go somewhere else and that was from HMV.

You get a refund by having enough/ any information about the person who has your money.

JESUS christ, the__mayster didn't expect to be scammed for a ****ing gameboy. We all make mistakes sometimes, and the address IS confirmed.

and btw I can send you a gameboy colour for free as its just laying around,all you need to do is pay for the P&P if you want it

The mods aren't going to try and get any money back, they will probably ban him/her for having munltiple id's at most. :)

We all make mistakes, but anyone coming back here with tears in their eyes really need to think about the precautions they took 1st.

I don't need a Gameboy colour, my son has an advance and a DS lite, but thanks for the offer. :)

It doesn't need a charger it takes AA batteries, I think theres a Pokemon game too. I'm not sure about P&P i'll have a swim about the Royal Mail website and see how much

No, they claimed. As for items not going missing, I have had to claim myself on about 10 recorded delivery items and 2 special delivery items in the past 2 years.

I can guarantee that if I was sent 10 first class items in the post, that I would probably get 6 or 7 of them. I have mentioned this to the local sorting office yet they don't seem to want to do anything about it.

sadly people who try to help get a real earful here, theres a few of us that continually point out the rules and the guidelines and nearly most of the time get ridiculed, jibed etc,etc Most dont even read the rules/guidelines till theyve been conned, a 3 minute read may have prevented this, and if not prevented you would have had a home address and landline number, lessons learnt hopefully
