Vista Home Premuim upgrade for sale £40.00

I have a vista upgrade from acer which has not been used, for sale for £40, if anybody wants image or more info then please reply on this post
can be picked up or will be delivered standard if you want it to be special then around £4 extra

Are you sure its legal to sell this, and if so, can it be used on a non-acer system?

Is it part of the upgrade program offered on Windows XP laptops between Oct 06 - Feb 07?

why will this be illegal to sell its a valid license for an upgrade to vista premium that has never been used.

It only has the acer branding on the cover because they supplied it, its like the cd that dell supply (written dell all over it but works with others).

Okay, as long as your sure. Looks like an Express Upgrade CD to me and I'm fairly sure mine explicitly states 'Not For Resale', as it is an OEM copy that is legally tied to the machine it was purchased for. Also if it is part of the express upgrade package Microsoft offered on new laptops between Oct 06 up till Vistas release you are selling it way above its rrp of shipping costs only.
well i have just rechecked it does not say not to be resold anywhere , but it is part of the express upgrade package.

my understanding of this is anybody who has a operating system such as win xp vista basic can use to upgrade. is that not the case.

let me give you an example , if i bought a pc package and i sold the monitor, thats allowed although it came in a package. and this license(came with the package) hasn't been used, the one i am using is the xp that came with it.
Okay, as far as I am aware, if it is a Vista Express Upgrade CD, your not allowed to resell it and your not allowed to use it and the XP its paired with simultaneously (although you can). If its part of the Express Upgrade Program (between Oct 06 and Mar 07 new PCs and laptops with Windows XP Premium and MCE came with the option of purchasing an upgrade CD for Vista Home Premium for a nominal fee, via a website) then I'm pretty sure the license for these particular upgrade CDs is OEM and stated for use with the machine the upgrade came with only, and when installed you are not allowed to use the original XP license.

What I'm not sure on is whether its possible to do so or not (ie whether Microsoft do log such use or inactivate the keys etc), or if it will work on a non ACER system, but I think if you sell this on it has to be with the system and XP license it was originally purchased for.

If its not part of the express upgrade program the EULA may be different and as it hasn't been used you might be able to sell it on (but you had better check the EULA carefully, or perhaps call Microsoft and ask, before doing so...).

I'm honestly not trying to threadcrp here either, just warning you and any potential buyer that both licenses (XP and Vista) might be technically void if it is sold on so its worth checking carefully before proceeding


Edit - just to make clear, you are allowed to sell it with the original system and the OEM XP license (you would need to sell it with both licenses) - the monitor is not part of the system but the motherboard (and possibly other components) is - I tried to find a clear link on the Microsoft page but can't find a specific EULA so I think your best bet would be to contact them and clarify.
