Hey everyone.

I'm trying to sell this for my son, he bought this console on the 31st of August 2008 and recieved it on the 3rd of September, but when he tried to get his gamertag back it wouldnt let him and has since found out the because he didn't renew his card details then they have canceled his account, so he doesn't want the console anymore.

It has been advertised on other sites but he has since ended them as I told him I would advertise it here for him.

So it's the new 60Gb console with all the bits that come with it and the receipt, as it's so new it's in imaculate condition.

I do have 100% ebay feedback if im allowed to link to it? I can do if it's not against the rules.

I'm trying to add a picture but not sure how to do it, anyone help? please.

No games as the one he ordered hasn't turned up yet so that will be getting sent back when it does.

As for Xbox Live i know he registered the console which he had to do when he phoned up to try and recover his gamertag and find out why it wouldn't let him, but he definately has not played online with the console.

Thanks for the offer but I think he just wants to try get some of his money back, he's abit annoyed with how Microsoft treated him over his gamertag.

I'm not sure what them rules are, as far as I know they will only refund the money if it is faulty or damaged, which it isn't, I'll have a look at the rules though, thanks.

Cancellation periods
The regulations give consumers an unconditional right to cancel an order. This is to allow the consumer the opportunity to examine the goods or consider the nature of a service.

If a consumer cancels an order, written notice must be given to you by:

goods – seven working days from the day after that on which the goods are received by the consumer;
services – seven working days from the day after that on which the consumer agrees to go ahead with the contract.
If you fail to provide consumers with written confirmation of all the required information, then the cancellation periods can be extended up to a maximum of three months and seven working days. If the missing information is provided during this time, then the cancellation period ends seven working days beginning with the day after the full written confirmation is received by the consumer.

Where a contract is cancelled, the consumer must ensure that reasonable care is taken of any goods received and 'restore' them to you. This does not mean that they have to return them - unless you stipulate this in the contract - only that they make them available for you to collect.

You must refund the consumer's money as soon as possible and, at the latest, within 30 days of receiving the written notice of cancellation. The consumer may, at your discretion, be charged the direct cost of returning the goods, but you must tell them about this in the written information you give them.

If payment for the goods or services is under a related credit agreement, the consumer's cancellation notice also has the effect of cancelling the credit agreement.

Thanks, will try ring them in the morning when they open but I'm not holding out much hope of a refund so if anyone still wants to buy the console then you can.

Is the £165 delivered or plus postage?
I'd guess with the weight of a 360, postage would be pricey.

Seriously, if you bought it from an online shop then as long as you call them and state your intensions before the 7 day period is up and mention that you want to send it back under the distance selling regulations act, then they have no choice but to issue you with a returns number and let you send it back for a FULL REFUND.

You just have to shell out for the shipping costs to get it back.

And it is 7 days from the date you recieved it, not from the date of your order, so you still have a couple of days to sort this out! Do it today and they have no choice but to let you return it, opened up, used what ever it doesnt matter. You get 7 days to test something and decide if you want it or not. In your case, you dont. Fact is within 7 days from recipt, you dont need to provide a reason, they HAVE TO TAKE IT BACK!

Phoned them and they won't take it back, said it's not their policy, really just want rid of it now, no one interested? I'll give it abit longer before putting it on ebay.

What shop did you get it from, even ebay buy it now purchases are covered by the DSR!

It is a legal requirement in trading.

Ive just clicked on with the dates of when you bought this and like Geeza said they really have to refund you on this one m8 it's the law. Surprised PLAY.com are being like this with their customer service as ive never had a problem in the past.

Here is an extract from another website, all websites ie not shops where you can walk in and buy the item have to adhere to this regulation. They may state their own policies and try to stick to them in order to avoid losing money, but fact is, the rules are there in the consumer act for a reason.

This is not specific to Overclockers, it is just overclockers abiding by the rules and using the standard policy with their name pasted in instead.

Just go to order history on play, then click the item, and click returning, then state the reason. Send it back, then get your refund.

I did it with a £300 PS3 so dont understand why you cant do it
