EXPIRED - Orange charging for 07978 international calls - you can terminate your contract early!

If you look at your latest Orange bill, they are going to be charging for numbers like 07978 that are used to call abroad from December 15th. However, there is a clause in the Orange contract which enables you to terminate the contract early.

it is clause 4.3 in that link, the clause is:

"4.3 terminating your Contract because Orange has changed its terms
You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). "

So if you want to cancel your contract early because of these changes, do it quickly but avoid paying for the remainder of your contract when Orange no longer give you any benefit!

People have managed to do this before on Orange because of 07744/55 charging:

Suggest anyone wanting to do this start using these numbers now to prove history of usage and negative efffect of new T&C's

I've spoken to Orange today and they have confirmed that I can cancel because of this - so I've written my letter out today. They'll have to cancel because my call log has plenty of 07978 numbers (mostly those!) and I am adhering to their terms and conditions.

Also, because I bought my phone from a third party (cashback deal) company, I don't have to return my phone either as Orange didn't provide the phone, they're not bothered!

Very straight forward to cancel under the terms of the contract as detailed by the OP.

Remember you also have the umbrella protection of the Unfair Contract Terms Act as the [supplier] has changed the contract and that change is detrimental to the [customer] in respect that the [customer] conditions have changed with regards call charges in this respect.

Regardless though, the Orange contract clearly states you have the right to cancel if they change the terms of the contract. As for start using the number – this is still a very grey area and if you stand your ground I believe the second paragraph of my post will apply in all instances.

I have 3 contracts with orange and would like to get out of them early.

Would i just write a letter regarding the 3 contracts i want to cancel and thats it?

is there anything else i need to do ??

Also where to i post the letter to?

You need to include more information to be able to answer that.

1. If all your CTN's are in the same account then pen a cancellation letter detailing the overall account number and state the letter applies to all numbers in the account.

2. If all your CTN's are billed individually then you'll have to pen 3 letters detailing the different CTN's

Remember to clearly state the condition you are cancelling under and send your letter recorded delivery.

Also does it HAVE to be in pen and paper??

I'm rubbish at standing my ground, I tried to cancel last time they started charging for the overseas numbers... but was told i didn't use them before now, so I can't cancel

Again, as in my earlier post the area of 'you haven't used the numbers' is very grey and in the event that you are getting stick about cancelling then you always have the small claims court for any further charges.

In the event that you are considering the small claims option then you are obliged to take every step to resolve the matter with the supplier before presenting your case before a Judge in the small claims court.

Yes, write a letter, print it, sign it and send it recorded delivery.

Don't get yourself into a position that you feel uncomfortable with. Conduct your correspondence in letter form only and if you are contacted on your mobile via customer services, end the call and state that you will not discuss the matter on the phone.

Networks are using the 'you haven't called the number' as a tactic to stop disconnections, which I think is a little naughty and I would also argue breaches the Unfair Contracts Act.

12 second call to 07978 *** *** = £0.10 and units thereafter.
