Car insurance repair. What are my rights?

Ok I know I could get a better answer if I call my insurance company, but I may get a better response on here.

My wife's car was bumped in the local supermarket car park way back in March. Nice lady leaves her details and everything follows as it should.

After a few calls from the other ladys insurance company, the car is booked in to a local body shop for the 1st of April.

1st April she takes the car to the body shop and a hire car is waiting and she is told it will be a week or two to fix it. "Does this mean I'm leaving it here from today?" my wife asks. They confirm that that is correct and she leaves thinking, how convenient, a hire car, no back and forth for estimates and waiting for a date for the job to start, just leave it all to them.

So we have a hire car and we are not inconvinced at all. After 3 weeks, I realise that the MOT runs out on the 30th April. We call them and they say "Not to worry, we will have it done by then We call them again nearer to the 30th. Same response. On the 29th I call and mention the MOT issue again. I get the reply "You are insured if you are driving to a test centre and are booked in for the MOT" I know that this is correct, so again I feel no problem, we have the hire car anyway and the test centre we use is over the road opposite the body shop, why panic?

Well today, 6 weeks since it went in for a minor bumper change over, they call to say it is ready. They are delivering it to our house at 11 am Thursday.
Because of work etc, I can only make it back for half an hour to receive the car back and check that I'm happy with the repairs etc. The problem is with the MOT. Again, due to work etc, I can only get it booked in for Friday afternoon.

After that long rant, are we being unreasonable if we insist on keeping the hire car until the Friday afternoon?
Another annoying issue is that I could have claimed back a months road tax had I known it was going to take so long.

change the delivery day to friday?

the tax thing is unreasonable, you have still been using a car so don't really see the problem there.

Well if their delivery estimate is as good as the one on the repair, you won't see it till next saturday

What if your MOT had not expired, would you have a genuine reason to hold on to the car. Dont think it an excuse to keep the car

Can you not tell them that you want to collect it on Friday afternnoon, and that you will return hire car then? It saves them the hassle of delivery so they will probably be ok, tell them that you cannot be in when they want to deliver it. If you only have half an hour on Thursday you would be cutting it fine anyway, I don't know any garage that actually deliver when they say they will, its usually a few hours wait. Better to say you will collect but it won't be till Friday. Good Luck

Flip, listening to that my dad must be the best, most decent, honest car repairer alive. He'd never dream of treating customers like that, anyway you remember you are the customer and call them and tell them to deliver it on Friday.

I had a smiliar situation, car repair in for ages, about 10 weeks in the end
My MOT ran out, mid repair and what they did was clearly better than how you were treated.

They left me the hire car, and dropped my car off, post repair at the MOT centre of MY choice. Then, when MOT had been done, i drove the hire car there, picked up mine and was met by a recovery truck who took back their car.

You should speak with the repair company and explain and if not, ring your insurers. You should not be incovenienced, esp since not your fault

We do repairs and most cars stay a max of 3 days, we dont want them clogging up the workshop.Only write offs stay longer than a week.

Sometimes its the insurer holding it all up though, if they insist on sending an engineer or if the third party want to inspect it can add weeks onto the repair.

Cheers for all of the replies guys,

I did kick up a bit of a fuss at the time it took to repair (6 weeks). I then called the hire company told the them it wasn’t my problem and to sort it out with Prudential.

I then got a call yesterday from Prudential. Very polite and apologised for the time it had took

Just got the car back this afternoon at 5:30. The body shop arranged for and paid for the MOT (it passed), and delivered it to the door.

I’m very happy.
