Easyjet flight cancelled - am I due compensation?

I booked my sister-in-law on a flight today, and when she went to check in she was told the flight had been cancelled. Initially she was told it was because the plane was needed for another flight, then she was told it was due to a mechanical failure. She was been booked onto a flight 6 hours later. When she asked at CS desk she was told she was entitled to nothing as she was being booked onto another flight, however I think she should get some kind of compensation - can anyone advise me?

As far as am aware, these low cost airlines provide no compensation for cancelled flights at all and they usually have this in their T&Cs. They claim that this helps them to reduce cost which gets passed to the consumer

What if my flight is cancelled?

If your flight is cancelled or you are denied boarding because it is overbooked, you will be entitled to compensation unless the airline can prove this was a result of "extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken".

These could include things like strikes, bad weather and political instability.

If the airline is to blame you will be automatically entitled to a full refund and a return flight to the first point of departure, or to have your journey rerouted.

Compensation for a delayed flight varies depending on the length of your flight and how long your arrival at your destination is delayed as a result of you being rerouted. The amount to which you are entitled is as follows:

· €125 (£99) on a journey of up to 1,500km delayed by up to two hours

· €250 on a journey of up to 1,500km delayed for more than two hours

· €200 on a journey of 1,500km-3,500km delayed by up to three hours

· €400 on a journey of 1,500km-3,500km delayed by more than three hours

· €300 on a journey of more than 3,500km delayed by up to four hours

· €600 on a journey of more than 3,500km delayed by more than four hours

If your journey is delayed as a result of a cancelled flight you should also receive assistance at the airport in the form of free meals and refreshments, telephone calls and, where appropriate, hotel accommodation.

When cancelling a flight or denying boarding, the airline must provide each passenger with a leaflet outlining their rights and the amounts of compensation due.

Yep, no comp from Easyjet, you can write to them, but unlikely you'll even get a reply.

I suspect the simple answer is 'no' you're not entitled to anything - they got her on another flight, which she accepted.

But what about the European Commission introduction of compensation rights in 2005 for flight delays? A company can't get around the law by putting something in their T&C... but, as far as I know, the rules may have changed since 2005. I'm not an expert.

It seems that she wouldn't qualify just because they could say there were 'extraordinary circumstances' - which is the loophole (and which is probably why they went from saying that they had used the aircraft on another route to saying there was a mechanical problem)...

It all depends on what travel insurance she had ?
I've traveled lots with EasyJet & Ryanair & never had any problems (touch wood!)

on a different note we missed our flight last year to amsterdam due to not hearing there last call for check in .. saying that the problem being THEIR system not working properly so they were shouting out ... we had to pay for it at the end .. they did not care about it ... and just said to book another flights ... very unhappy easy jet customer since then ... shame we did not have insurance then as well to cover ...

I thought that the airlines were obliged to pay out on cancelled/delayed flights regardless of the insurance status.

The problem is that Easyjet seem to ignore any rules that come out, they are a law unto themselves.

There is no automatic right to compensation for flight delays. I've had this issue and raised it with the Air Users Council when I had a flight from Barbados delayed for 7 hours. This was not a mechanical failure, just the airline being unable to catch up on their schedule.
