You need to understand how Apple's return policy works here... if you buy a device from them you can return it for a refund within ten days for any reason at all. As soon as that happens it's a refurb unit. I've seen people return iPod's becuase they're the wrong colour (obviously when bought as presents), becuase they went for, say, an 8Gb model then found after using it for a day or two they needed a 16Gb model, because they weren't happy with the way iTunes works and on and on and on. Doesn't have to be physical defects with the product.
I've just bought a 16Gb iPod Touch for my wife as a birthday present and I was amazed - it really does look like new, all the accessories including the little stick on plastic screen cover thing, the only thing it's missing is the original retail box. Not a mark or blemish anywhere. If you want an iPod Nano feel free to go for a refurb unit, you won't regret it.
