No I don't think they can make her work a months notice. Is she weekly paid? ACAS will tell you. They are online and maybe you will find it there but if not a quick call on Monday and they will tell you.

Have you checked contract for terms after she has been employed for a certain perioid with the company, the longer she has been there the longer notice applies on both sides.

sounds like a tool of an employer, bet you any money they try and short her on holiday pay outstanding etc....get ACAS on the phone tell them, then get your daughter to tell her employer what ACAS have to say

You dont need to give any notice at all.you can leave tomorrow and they cant do anything to you at all.

If the contract says 1 week, that's what it is. Nothing they can do to change it.

You have proof of this... ask them to provide a signed copy that suggests otherwise.

1) it is a general contract not specific to her,
2) being as she is paid monthly she needs a months notice, and ..................
3) how does she (our daughter) expect her to advertise and employ a replacement for her in a week !

We have told her to stick to her guns as she has it in writing it is a week and as far as we are concerned that's it - end of. But, she's concerned that being as she doesn't paid until the end of the month she will not get her full entitlement. Also, they sent the contract to her home address, she signed it but her employer never did. We believe this is still ok as they supplied her with the contract in the first instance.



well thats the companies fault for giving a 1 week termination notice...not her fault


if they try and withold payment ACAS will get involved probably...its illegal either way, give em a court notice they would back down or lose


stick to your guns....speak to ACAS anyway, then they try anything (which they will) you can be ready for it

LOL..... So they are concerned they can't fill her post in a week! Maybe they should employ better staff in their HR department - preferably someone who understands something about contracts!

It's quite amusing they are using their own failings to try to penalise your daughter.

1) Contracts are never general. They are your personal agreement between you and your employer. They may be generic, but thats irrelivant.

2) I get paid monthly. Should that mean I only need to give 1 months notice and not 3 as it currently stands? People get paid weekly also - but still have to give a months notice. All totally irrelivant.

3) Thats just so amusing its not even worth answering! (Though I did above anyway!):w00t:

My 2 pence worth. If the contract says 1 weeks notice then that is it. Not sure what they are on about with the 'general contract' unless they have issued another contract which your daugher subsequently signed the contract in force is the one she signed. Any change they try to implement now would be a unilateral change in her terms and conditions which they cannot enforce.

On a practical side even if the notice period was 1 month what can they do sue for 3 weeks pay? That is not going to happen.

you are correct - if a person decided to just not turn up there is nothing that can be done - it is commonplace to give 1 week notice for each year of being employed by the company

Tell them to stick it - the contract is legally binding - if you have been presented a contract which was signed it is not general. Call his bluff.

yeah speak with acas, they have helped me loads in the past, makes me sound like a real awkward sort but i needed the advice and they helped, really friendly too

if contract says 1 week its 1 week, the only reason they said about the being paid monthly is prob cos they are to **** to work out her wages and that is there fault, if she trys to go to her old job after a week tie her up and dont let her. If I was you I would go down to her work and say somthing to the manager show her/hiim the contract and say she better get paid up to her last day and it will include any holidays she is owed, or if she has holiday left take it and go in for less then a week.
