i got it :(.

I've had my xbox 360 for about 11months and 10 days, brought it from HMV (got recipt although I cant see a date on there)

is there not a law that state goods must be fit for at least 1 year or something like that, so I could take it back without any fuss?

What should I do if they refuse to take it back? I brought it from a HMV in bham but going to one in walsall to return it

because you have had it and used it for over 11months - the supplier only has to get it repaired - so long as you have your receipt - if you do not have a reeipt they do not even have to do that

I'm no expert but I think if it is within 6 months the onus is on the retailer to prove item is fit for purpose (or something like that), after 6 months the onus is on the owner to prove it was unfit. However some argue that as this is manufacturing fault and has been acknowledged as such then you should get an exchange by the retailer (as they are selling goods that have a known fault).

However I think it will just depend on the store policy and how much you are willing to argue. You could phone Walsall Trading standards ask their advice.

Sons just had same problem,if you go to web site xbox360 support you will get number to phone tell them whats wrong and nice person on line, will say that xbox will repair for free,and extend warranty for three years from orginal purchase date,(sounds like a sweetener for known problems with the consoles.

If Harvie gets a new one from HMV it will probably be a Pro (ie have HDMI port) which is preferable to a second hand exchange......I'd definitely try the store first and use MS as the last resort.

yeah thanks for the help guys (all repped) im going in tomorrow to try and get a replacement, just trying to find any sort of law which will help me get an excahnge, I have got the recipt.

I suppose I will just ask the manager to put it in writing that they will not offer me an exchange for faulty goods.

I thought there was a speifc part of the sale and good acts which covers me for this, I cant seem to find it though :|

If they dont give you a replacement tell them you are entitled to one. Dont have any of their bull and demand a replacement.

No, you are not ENTITLED to a replacement. You are entitled to "a replacement or repair", and it is the retailer who decides which is applicable.

Wrong. They CAN offer a repair by sending it back to Microsoft. You need to read up on consumer law my friend.

But anyway, congratulations mate, its nice to see that at least one retailer has seen sense by replacing it. :thumbsup:

They could have sent it for repair. A lot of high street stores will swap it out but they are not obligated to do so.

I love how deathtrap reads what he wants in to the statutes and then says not to take bull from the shop :D

Yeah, well, I was once an assistant manager for a large UK chain store (one that sells bikes and car accessories :whistling:), and had to study the ins-and-outs of consumer law. It was heavy reading, but worth it in the end. Of course, that was a long time ago so things may have changed, but I doubt it.
