Acer Aspire Help! Will Rep Help!

Ok so I ordered a acer aspire free with my 1Gb 3 mobile broadband which arrived today.

I charged up the laptop for a few hours, then turned it on only to be welcomed by an error message on the opening boot screen.

Now, Iphoned 3 customer support and they said to phone Acer technical support.

I said to 3 that surely they sent me a faulty product and so they should replace it for me, as they would with a mobile phone if that was faulty. (sale of goods act etc)

SO I ask you lovelly people, who is right? Who should be replacing this for me?

Rep for helpers!

3 should replace it. Sale of goods act.

Neither, it's generally the retailer you go to first (although that may be three if you bought the package from them).

In all fairness, there's no proof that you didn't do something to balls it up. Why would Three then go out of their way to replace it without you at least "trying" to have it repaired? Surely you'd rather have it working in a day than waiting 5 days for it to be replaced.
Hardware faults and returns are dealt with via the manufacturer on laptops that are subsidised by the deals that Mobile Networks provide.
Phone Acer.

As for "3 should replace it, Sales of Goods Act". Prove it's faulty. They're asked you to speak with Acer, so do that. Or get a friend that knows something about computers to have a look. Try booting into the recovery partition (usually F5 or F10 on bootup on these netbooks)

The Sales of Goods Acts states that it is the supplier who has to prove the fault within the first 6 months

just turn it all off - take out the battery for a few mins - turn it all back on again

very occasionally my aa1 freezes but sorts itself out if you give it 10 mins or so

try it

To be fair, why SHOULD he have to go hunting round in the BIOS.

He bought a new computer, he gets an error when it starts up, so they need to fix it.

cos its an easier fix than i thought mine would be, if he can access the bios, and the HD is listed then its not the HD thts the problem and asuming its the same problem i had i know how to fix it

Its the first page past the welcome acer screen after I switch it on. Acer told me to do the same, they are sending my instructions now via email, so i will give that a go.
