Ok we all know what's been going on with the Littlewoods £25 voucher fiasco- I for one am pretty peeved at having £25 added to my account months after my purchase.

For those of you who've been hibernating for the past three months, http://news.bbc.co.uk/1/hi/business/7061767.stm here's the BBC / Littlewoods version of events . (Thanks Kallisti for the link.)

I'm hoping we can do something about this rather than moaning in the misc forum- I think we should start a petition so we can get an idea of how many people think that Littlewoods should honour the discount that was agreed at consumer checkout.

But....
First, from a legal point of view, does anyone on here study law, or have a law background who can offer sound advice?

Second, if Paul is willing to be the face of the campaign, I think we should perhaps link an optional donation to the petition, hopefully a few of us can contribute financially :)

Third, if anyone has spare time over the weekend where they could perhaps set up a webpage dedicated to this (any ideas/helpers, please list below)

Fourth, if you're a member of another forum (MSE for example), perhaps you could have a scout on there and see whether there's the same kind of feeling about this elsewhere.

I've got time on my hands during the week at the moment so I'm willing to do any administrative work, but we'll need to work together if we're going to get anywhere with it...

So hands up who can help?!? :friends:

No idea about the legal nitty gritty, but maybe snakeyees21 could have a word with his mate and get some advice?

Also willing to make a donation towards any legal costs incurred, although I guess these will be refundable once we win!!

As I said, as far as the technical/legal side is concerned, I'm pretty useless, but the whole thing needs pulling together properly if we're going to get anywhere!!

who gets to pull all the strings in terms of enforcing that debt. Before, LW were saying you owed them money. Now, the tables are turned. So you start with this:

Dear ,

I refer you to my account #number, and my recent payment of in relation to this account.

I am writing to advise you that, while I have made payment in full in order to mitigate against additional fees on the account, I am disputing this payment. My reasons for doing so are as follows:

On I placed order reference with you, for a total cost of . I used a promotional code for £25 in part payment of this order. According to clause 2.3 of your terms and conditions of sale, acceptance of my order is subject to Littlewoods confirming that my code is valid. Clause 2.2 of those same terms and conditions confirms that acceptance of my order takes place at the point of despatch.

Littlewoods confirmed that my order was acceptable, including any promotional codes, by dispatching the goods. You further confirmed that you had completed your contractual obligations in validating this code, by refunding £25 to my on .

As such, I consider your claim that the promotional code used was invalid to be entirely without merit. I require a full refund of , to cover . I also require that the voucher already accepted as payment by Littlewoods be re-applied to my account.

Please be advised that I have no interest in entering into lengthy correspondence regarding this issue. As such, if I do not receive a full refund, along with confirmation that my account is in order, within 14 days of the date of this letter, I will initiate proceedings through the County Court without further notice.

For claims of 5k or below this is true. However, if we get enough people together to make a joint claim, then it will have to be dealt with in a higher court will it not?

Hi, i don't think i can really help much because i don't really know much about making websites or law but i think this article is helpful because it shows that Littlewoods have known about vouchers being shared on forums for a long time and are most likely exploiting the release and spreading of codes to gain extra sales. Or if not exploiting it they are at least ignoring it because they are quite happy to have the extra sales.

I have not been affected by this, i should say yet as im sure littlewoods direct will start next, then i will be affected, just wanted to wish you all luck and if theres anything i can do just give me a shout :thumbsup:

I think it may be best to split discussion into a separate thread and have this thread only for those who agree on their course of action.

Let a lawyer give advice once there is a body of people and a clear joint story.

Guys - on my part here is what I suggest and what HUKD can do to help.

1. start a thread that details the story, just the facts as detailed as possible with all the dates etc. Keep opinion out and just outline the facts of what has happened.

2. Get members to post in the thread with their details and whether their story is exactly the same or differs on any details. Any differing facts should be posted in the thread.

3. Get those members to email the organiser (make a special gmail account) with their personal details so a contact/data list can be made.

4. HUKD can put a link in the header notifying members of this thread to help spread the word.

5. Once there is a sufficient number of people with a consistent story legal advice can be had.

6. DO NOT PUBLICLY SPECULATE ABOUT LEGAL RAMIFICATIONS. Gather the info and then a proper lawyer can be approached.

7. If enough people sign up to the thread, give their details and have a consistent story (let's say 100) then HUKD can help get legal advice for the group so they know where they stand and if any of their consumer rights have been affected.

I'll PM you both the domain name - which isnt directly littlewoods directed (that would be asking for trouble) but very topical! I think your'll both like it! The site in question would be hosted in the US and domain details cloaked. Probably not any protection at all - but not really sure if protection is needed if the details are truley accurate accounts!

I am in no way a lawyer, so take this info with a sense of scepticism.

I believe any court action with regards to money will 'fail' ultimately because Littlewoods have broken a few laws, and will pay out long before it reaches court.

If you retain the services of legal professionals for this aim, then you may as well save your time & money and claim via MCOL.

If you take Littlewoods to court over another matter, then it will have 'more legs'. One matter that springs to mind is them opening up credit accounts for customers, without customers ever authorising this.

If this has happened to anyone, I suggest that they ask Littlewoods for a copy of "My signed credit agreement". :thumbsup:


I would firstly approach a lawyer and see if you can get a 'Free half hour' consultation. :)

I'm happy to do any website work, hosting, domains etc... can set up forums, polls, petitions whatever. I'm a software developer so database work etc is all doable. If someone who's doing the organising wants to PM me I will give you my email address. I would also be happy to get into a class-action if that happens.

I emailed Consumer Direct regarding this mess and this is the reply below.


Thank you for your enquiry to Consumer Direct dated. Your reference number for this case is ******** and should be quoted in all further correspondence regarding this case.



Based on the information supplied within your email the key facts of the case appear to be as follows: You placed an order with Littlewoods using a £25 voucher, you paid the remaining amount on your credit card. The order was processed and the goods were delivered, since receiving the goods you have been contacted for payment of the £25 as T state use of the voucher was not authorised.



You have an initial contract with Littlewoods as an order was placed and payment was exchanged, as a Consumer you rely on the care and skill of the Trader to process the order correctly taking into account any vouchers used.

If the Trader processed the order and delivered the goods without querying the use of a voucher prior to delivery then [SIZE="4"]Littlewoods are in Breach of Contract under the Supply of Goods and Services Act 1982 and should not persue you for further payment. [/SIZE]

[SIZE="4"]You should rasie this breach in contract in a formal letter to their head office,[/SIZE] sending it recorded delivery so you can prove that the letter has been received. Quote the Traders breach in the law and request that they confirm persuit will be dropped.
