advice about an ebay purchase

hi can anyone advise me where my sister would stand with this, she bought some tickets to see a comedian at the MEN this friday, she bought the tickets months ago on ebay and payed right away, the seller said he recieved them last week and would post them out, anyway she still hasnt got them and has emailed him a few times but he hasnt replied. he might just be busy but she is getting worried now as they cost £160. he has 100% feedback and its all for selling tickets so she doesnt think he is trying to scam her but if the tickets dont arrive ontime can she claim her money back or not as the tickets were bought months ago. she also payed for next day delivery thats why shes getting worried. thanks for any advice.

She should be worried. By the sound of it, it has now gone past the point of a Paypal claim which is 90 days I believe so if the tickets don't turn up - she can't do anything about it (unless she takes them to a small claims court)

i think she will have to ring paypal see what they say as im sure she said she cant see an option to open a dispute but will check with her after. its probably to late but its worth a try.

Before opening a dispute, why doesn't your sister ask for the tracking number of the next day delivery service and then she can also look for herself to see where the tickest are. Unfortunately, sometimes even tracked items go astray :-( Sounds as though this may be the case, especially if the seller appears to be reputable.

shes emailed him a few times since he said he posted them but he hasnt got back to her.

I think you have up to 45days to make a paypal claim...

When did he say he posted them? The time element of the Special Delivery service has been suspended due to the volcanic ash (even though most SD's go by road). So there could be a delay.
