advice on where i stand legally i was coming home and i was driving slow indicated on the busy main road to turn into our road and as i turned into the road my car started to slide i hit the rear wheel of a large van that was parked half on and half of the curb on the corner which was also blocking the other turning i have pictures just trying to decide wether to go through my insurance or ask them not to as there looks to be no damage on his works van and he said it was an option if he had no damage i know it probably wont matter about the illegal parking just wondered why he might offer it as an option

He might offer it as an option if there is no damage to his van, maybe? Why would he want to go through the insurance? What would he be claiming for?

Just report it to your insurers, that is why you pay them.

You do not know if the other vehicle has been damaged.

I would say you are at fault, if you lie and say you didn't lose control he will tell the truth and you will lose anyway.

His parking is no defence to the fact that you hit him unfortunately - whether he should be there or not does not mean you can hit him without it being your fault - he was parked, you hit him, your fault. If the van is privately owned then have a word with him and make sure he is happy not to bother with the insurance, but if t's a company vehicle, then that's not his decision to make, and you'll be best off informing your insurance company to be on the safe side. Good luck :)

Unless I'm mistaken she's not asking who's at fault. She appears to be asking why the van driver would agree to leaving the insurance out of it.

i was once reversing out the docs at the same time as the boots prescription man was. i stopped but he carried on and hit me. it wasnt a big hit as he was doing like 5mph! i got out and was like i need insurance details cos u should getit checked in case something wrong with car....bbut my mum was with me and she said leave it...u know neither one has damaged cars so just leave it. the guys was schocked, but sometimes i guess u just think sod it if its not that big a hit. maybe the guys felt sorry for u cos he knows the snow was really bad and is doing u a favour?

usually it's because the other party doesn't have insurance , they want t get out of there before anyone calls the law
