my o/h company has brought in random sample testing -
multi-national company -
people been suspended when there on beta blockers etc

is this legal

If they've agreed to it in their contract, then yes. If not, it's debatable as I wouldn't think a company could force you to take a test unless there was suspicion.

Surely it depends on your contract? if it states in there yes, but whether they can fire you for it I don't know.. you would have to contact ACAS

I always ask them if anything doesn't seem right and they are pretty useful, give them a try, failing that maybe ask a solicitor

They most certainly can. False positives such as not recognising Beta Blockers should not occur if the correct information is given to the tester, and the test is carried out correctly. To be falsely accuse allows you to sue them.

Yes they can and do. My employers have regularly tested for illegal drugs for about 10 years now. Failure or refusal is instant dismissal. They have even introduced random breathe testing, with the same outcomes for failures. I work in the aviation industry. Would you want to fly on an aircraft that been maintained by someone drunk, on drugs, or both? There are many jobs that have a similar safety requirement, even if its just the safety obligations to their workmates.

I've worked in jobs where drug testing was compulsory, & in jobs where there was no drugs testing. Whether or not a company can force you to be tested depends entirely on your contract - If the company are only just introducing a policy now & it's not in your contract then you need to get advice fast!

yes i understand for jobs where there maybe a risk such as driving aviation etc

the most technical thing for my o/h is pressing buttons for

1 - the lift
2 - coffee machine
3 - mouse button

there are a few people been suspended due to rests showing prescribed drugs - i think they would have good reason to sue them but they wont due to wanting to keep job!!

The company I work for carry out random drug and alcohol screening. They also carry out post incident testing and a refusal is a failure.

If its just new, then chances are its not been written into his contract if he worked there before they started.

It's an invasion of privacy, and i'd say its against hte principles of the Data Protection as well.
They dont need to knw what you do in your private life, and this is an onvasion of it. (Pilots/ Army, have to, but thats already in their contract).

If you go to Amsterdam, partake in some waccy-baccy and get tested on the monday (or even weeks later, when it can still have residual traces) and get sacked.
What have you done wrong?

I'd refuse, but then i cling to the few freedoms we actualyl have left in this country.

i said that - refuse - just in case they find traces of arsenic im feeding him(joke) got a good deal on life insurance few months ago lol

serious side thou - its gong to far - they could pass it on to others - ie database for dna - etc
