on advice from admin - HELP!!!! please

Going back to the software/laptop missprice thing months back and on advice from TS I am about to issue a claim against Littlewoods. TS said that as the initial order was confirmed and that only 'part' of the order was supplied I should have a strong case. I bought on interest free over 20 weeks. I have since received 2 statements - the first i rang and said it was in dispute. The second saying i need to pay £131.20 or £59.60 which is arrears and includes a £12 admin charge. Ive tried ringing this morning and all lines are busy call back later!
Admin says you lot might be able to offer some advice or moral support

If nothing else it'll be interesting to see how far you take this & how far they let it go. I've seen more than a few people ranting on about taking retailers to court if they don't get this mis-price or that offer & at best they're whining for the sake of it or hoping for a voucher or discount against their next order from the same supplier that's just turned 'em over!
The bottom line would seem to be that the legislation on internet transactions is so full of loopholes that the E-tailers can make up the rules as they go along!!!
Good luck with your case, as the only way things will improve is by people like yourself actually going that extra mile & setting the precedents.

so what will the end result be there? do you have the software? have you spoken to anyone? how can they not take the money? ive just got a admin charge on my statement. surely you owe them for the software at some point? or would need to return it? even if you dont get the laptop.

Ive looked at that but there is the problem with them being allowed to change the item description cos they messed up. PR4277 is not a laptop and software anymore but just software (vista i believe).
Consumers direct say that its two different things. it is unlikely to be resonable to be able to get the laptop for £149 but changing the item description is something else

I would be interested to hear from members with more legal experience... but isn't the issue here not about reasonable expectation on the price (and arguably £149 is a substantial amount of money in any case so not necessarily unreasonable) but that Littlewoods entered into contract with you on the laptop package - included that in order confirmation and then closed the contract by shipping you the software. If they made a mistake they should have cancelled the order not continued it by shipping software only. Is that not where the crux of this issue is? Basically they advertised one item - gave you the confirmation for that - and then shipped another. I would say that has to fall under some kind of advertising law as they have charged your card and taken the money yet shipped an incorrect or partial item....

I Am Not a Lawyer and so forth but that's where I think this issue is. I would be interested to hear where consumer law falls on that.

have now just spoken to Customer services at littlewoods. They wont even put the amount in dispute or refund the admin charge cos they have delivered the order and as far as they are concerned it is complete.
I have the option of returning the software but have to now include all this in another lettter to HO

I think that is straight out wrong. Regardless of pricing or anything they sold you an item through deceitful means by advertising it and order confirming it as a laptop bundle. That they now consider the order complete is the most damning part of it I would think.

Did they ever send an email to you before shipping the order stating the description was incorrect and that they would only proceed if you confirmed it was ok to?

no - it was only ever flagged up after several emails where i queried where the laptop was. and even that took another 10 days before they told me there was a pricing error on the website

From their terms & conditions:-

3.2 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled

Ths is where they will have problems!

Their collections department have just cold called me - they obviously dont talk to each other asking me if i am paying off the arrears on a debit or a credit card!!!!
I told them it is in dispute but there is nothing on the account and they have no record of me ringing today or before!
She told me i should be writing to head office!!!!!!!!!! DOH!!! but their departments are not allowed to talk to each other about my account due to data protection

I dont have any legal training but definitely an obvious breach of contract specifically with the T&Cs Fireheaven posted. Good luck, you should win, but from my personal experience English Law is sometimes too obsessed with specific wordings of acts to actually see the intention behind it. Maybe you could find someone to represent you on a no win no fee basis?

right they cant take any money from me because i have an account with them so its an unpaid bill but they will not accept a refund because i have opened the original package etc. but the only way i found out that my order was only going to be different when i recieved the package, all emails i got from them said laptop with office even the one i recieved a whole week after the date the original order was made. the only time i got that confirmed that i wasnt getting the laptop was a few days AFTER i recieved the office package. that was the 1st time the word laptop was removed from the product description.

This morning i got an arrears letter from them! threatening that if i dont bring the account up to date it would affect my ability to obtain future credit!

well that wont really affect me because im living at home and in future i'll move away from this current address but i'm going to ring them and tell them that im still waiting on a laptop so im not paying for goods that i have not recieved

Ummm yes it will effect you. Your credit score will have all the details of you, where you live etc etc etc

It may be in your interest to still keep up payment for the items. You are currently in dispute about what you received not the cost. By not paying for it could complicate matters further. At the moment you are in a strong position but the last thing you want is yourself to be taken to court for non payment.
