I paid a fenching firm to come out and do some fencing for me , they not only destroyed some plants when i already made the required space for them , they also didnt complete the job.

Its nothing major which needs completing it wouldnt even take them long , yet everytime i call them im getting excuses.

I paid them cash because they said it would be £60 cheaper otherwise i would have to pay more by card , so i cant even threaten them with a charge back now :/

Is there any law i can threaten them with , or can these cowboys just do as they like?

Nope :( they gave me a quote form when they came the first time thats all i have

You mean you paid them the whole sum in advance? If so, your only recourse is to sue them. Good luck with that!

I did because they claim to have finished the job , i was really busy at the time and didnt have time to check it all out , yes silly off me and stupid to pay cash.

Is it hard to sue someone?? what proof would i need? i have a neighbour as witness

really dont want to go down that road if i can help it though as work is almost finished , not sure if i would even win , as they do most of the hard work ....i just want them to finish the damm thing off

Ring your local tax office and tell them you need to confess your sins of paying them cash in hand.......they'll probably have a look to see if they are doing this quite a bit and fiddling the tax man. :-D

if it isnt a massive biggie then i would finish the job yourself, and take it as lesson learnt and be grateful it wasnt a massive mess, and alot more money

Speak to citizens advice. They keep records on peoples previous behaviour with the sort of things,Dont mention cah in hand just tell them you were expecting a receipt but never got one,You have the quote as proof of who did it and you have a witness who saw them doing it,Just a phone call from citizens advice to them may scare them into putting it right,

Definately do it.........as you say you have done nothing wrong but if they are fiddling their books then they will get caught. The government won't let a penny go amiss. lol

How much are we talking about? There's a lot of work in initiating a small claims court procedure, but it's not that expensive ... about £60 if I remember rightly.

Syzable has made a good point, but don't go straight to the tax office. Call the fencer and tell him that you will go to the tax authorities and tell them the story. The fear for the fencer is that, while it may not be significant for your one-off deal, the authorities may initiate an audit on his company, and that's hell, even if you have nothing to hide.

Thanks will do that , have i done something wrong in paying cash then? can i actually get done for this by tax office?

Thanks for everyones advice , going to ring fencer one more time , if i get no where , i think ill just finish the job myself ....dont really want the hassle off court etc.

As i say the job is not massive to just finish off , it just means ive now got to go out and find the right part now to match the rest

No you can't get in trouble for paying by Cash as it's a valid payment method. :)

Only he can if he doesn't pay his tax and vat. :)
