advice needed - regard to hotukdeals member.

i brought a item of the forslae and trade forum . paid by bank transfer and seller claims they havent recieved - have statement to proof i sent it and they say not enough proof , i was also to send a ps3 game which i did and seller never recieved , got a bit weiry of this so filed a complaint with royal mail and they sorted out the refund explained to seller and got no where anyway to cut a long story short , the seller has now involved the police , so tonight i am to contact my local police and a solictor tomorrow . what i wnat to know is where do i stand ?
who cov ers the solicitors fees , obvisouly me for now but if all evidence is correct will the seller have to refund them?

any help would be appreciated .

If you are to be interviewed, you will be given rights, one of which is to have a free and independant solicitor free of charge. This is generally if you have been arrested.
Ensure you have all of your exhibits to hand
Are you being arrested? or are you attending volountarily?

bank transfer was october i think yes it was sent recorded , spoke to man a my post office and he helped me fill in a form and i got a refund back to the value it was covered by which was £10

if you have proof of posting, and also records of a royal mail claim etc then whats your worry? i assume the proof of posting has they buyers address or postcode at least?

It depends, dont know why the other party is involving the police, especially since you have a bank statement with his details on it and payment showing an amount.....so not sure what hes reporting to police?

Unless something criminal is claimed or reported then the police will prob say its a civil matter. In which case you can go to a solicitor and give him the necessary information and supporting evidence for him to complete or challenge any small claims action, which is prob where this will end up.

As far as fees go, you are responsible for your own fees to defend or pursue any claim unless there is something I am missing, in which case someone jump in and add more info. But what you can do is if you win the case is that you can ask the court to award expenses in your favour providing you can show that the expense directly relates to the case.

I'm not very certain in the specifics, the solicitor will explain it in more detail and the procedure to be followed, but keep any paperwork and should the cops show up then ask them clearly to explain what the complaint is first and get as much info from them as possible.

im not worried atr all have nothing to be worried about i posted it etc and paid the money , im just wondering about solictors cost every day i come on here theres a pm from the seller and to be honest its getting a bit stressful

i wouldnt bother with a solicitor.. you have proof of a bank transfer to him and proof of a royal mail claim so the police wont be interested me believes he using scare tactics.

did he send whatever you brought without checkin he had payment??

ahh, the old "its in the hands of the police" one. I am "the police" and I would not consider arresting you on the information that you have given.
PM the other party back and ask for an incident number and make the first move yourself to contact the officer alloctated the enquiry.
This sounds far from a criminal matter at the moment as there are too many variables. keep all correspondance from yourself and the other party, print them off and have them ready. if you have paid money anywhere have the receipt to hand. If you have delivered anyhting again, keep hold of the paperwork.
Please be aware, if the caller is claiming that they have not received the item or money and it can be proven that they have, then they have committed an offence of attempted deception. Please advise them of this if you wish.
I would be happy to look at your receipts etc. to give you some advice if you could scan them to me. I am a law trainer with 15 years policing. If I can help let me know

i brought the item of them paid instantly and they sent there item , the same day i wnet to post office and posted my item which was in the cost of the amount there item should of been .

ie item was £44 .00 so i paid cash of an amount and then game to cover rest i recieved mine after loads of messages saying mum hadnt had chance to go post office etc and so a good few days , then about a week later they pm me saying no money and no game they said they work for royal mail so not to worry with crimbo etc , i spoke to guy a post office and he said file a claim which i did had to supply proof etc ie - tracking number and stuff .. then they refunded. now thee person is saying theyve infromed police , so i said id contact a solictor tomorrow and they said i have no reason to but surely i do if they involved police to see where i stand.

I'm sorry, am I missing something here???

You sent the item recorded delivery, so royal mail should be able to prove it was delivered? They gave you a refund so are they admitting it was lost??

Also you can prove the bank transfer was sent as it's on your statement.

I would'nt even bother going to the police station. Seriously, what are they gonna do?

what is he pming you about?
the only thing i can think is that he sent whatever it is out but never got the game you offered to trade and is wanting a refund for the game he never recieved. If thats the case or something along those lines then he has a decent point and should be refunded anything that he has lost out on.

not to try and worry you but they wouldnt tell you you was going to be aressed before you got there as they know you wont turn up. sounds like your having xmas dinner in strangeways lol.

Sorry, but don't even bother, why should you pay out for a solicitor? they're just trying to scare you.

look i havent involved the police ok, i just needed to know what is going on. now i understand you have done deals before and this must just be one of those things.

so the guy never got his game or any cash but you got the item.

If thats the case then no wonder he is pm'ing you and if it is then its your responsibility to give give the what he's owed.

So you paid for the item and they sent it? Then they claimed they were never paid?

Dont contact a solicitor and incur costs for this. there is no need. I am moving towards advising you to contact the police yourself as it is looking as though they are trying to deceive you
You have choices here.
1 as above,
2 put this down to experience and forego any loss
3 pay them

You are in the position to decide what you want to do. For me, I would ask a mod to ban them from PM'ing you, if thats possible or get them banned from the site full stop
If what you are telling me is correct, I would ignore them or contact the police myself. There is a saying, dont get angry, get even. Play them at their own game. Please do not worry about this and do NOT pay for a solicitor at this time

Sounds like a little school kid who's trying to get his money back. Seeing as you've paid for something and your bank say you have then he has no leg to stand on. Also if he sent the stuff before receiving payment then he's a bit daft really isn't he? Don't bother going to the police if they want to see you they'll come to you what are you going to say to them anyway? Even if you did go don't worry about soliciters costs even the free ones would be able to sort this mess out for you, or you could yourself seeing as it'll get no further than you walking through the front door.

The police would not be invloved in something like this, they would not be interested. Trying to scare you, you have proof so it should be in royal mails hands, I mean not a lot you can do is there

Just a kid trying to scam you mate. If the seller hadn't received the money he probably wouldn't have sent the goods. He's probably regretting it now or spent all the money so thinks you might be a soft touch to get a few more quid out of.

aaaah in that case I wouldn't worry. you've offered a refund and have proof the bank transfer went through. The guy should take it up with his bank and chase them up to see what happened if he didn't get it.
now I'm tending to agree with the above posters that the guy regrets the deal etc and wants his cash back. wouldn't worry, assuming all this is true.

So royal mail admitted they lost the game? Fair enough, the person deserves the refund you receive from RM. But on the bank transfer, sorry but it sounds like you're being conned.

If royal mail have said its lost, pay them the £10 and tell them to take you to court for anything else they feel they're entitled to.

you say royal mail gave you a refund for the game? did you check the tracking number online to see if it had got there?
also for back up on the bank transfer side, get his bank details again and go to you bank and get them to do a copy of the transfer. your backed up then.

I wouldn't be surprised if they received the game too. At this time of year the posties are so busy. I've had a recorded delivery parcel put through my letter box this week, no signature taken.

You have the game and a £10 refund, so you are up on the deal?
other party states no game and no money? get info from bank and arguably the £10 is the other partys also?

goto the bank get them to confirm where the money got sent ie acct number and sort coden have them give you a copy of that confirmation and match it up to his details and then he cant dispute it :thumbsup:
