Advice needed regarding a problem with an ebay purchase

Evening everyone.

Im not usually up this late but Im a little worried and need some advice.

Earlier this evening I purchased an n97 off ebay for £257 from a user with only 4 feedbacks.

Before payment I sent an email asking if it was a genuine uk n97 and wanted details on the postage service he would be using.

He emailed back saying, yes will dispatch as soon as money is in my paypal account.

I then paid via paypal. He then emailed me saying its a chinese copy n97! I have asked him for a refund, to which he replied 'how do I do that' and I explained how to do it. That was over an hour ago and no refund. Im assuming he told me it was a copy and offered a refund because paypal have most likely put his payment on hold, due to him being a new seller.

What should I do, I dont know if I should create a paypal dispute because I havnt received the item yet and wouldnt know what option to file a dispute under.

I dont think you can create a paypal dispute its too early the best thing to do would be to ring paypal in the morning and let them know what he said as im pretty sure you are not allowed to sell duplicate products due to copyright laws and they should refund you shortly and the seller would go under investigation. nothing to worry about thats the advantage of paying by paypal.

He has now replied saying:

''it will not let me do it as the payment has not been released,so you can just cancel it,it says i have to wait 21 days for it to be released into my account but if you release it now i can refund it now''

How can I give him instructions to refund me?

report theitem - not as advertised - do your talking through ebay - not through buyer

tell the person that if he goes onto his paypal, and then clicks on details on the account activity page where it says the info about the sale, then when he clicks on detail if he scrolls down the page he can issue full refund.

He doesnt have to wait for the 21 days.

Hope you sort it.

Best way to go is to file a dispute with paypal straight away, I use ebay everyday and have 400 positive feedbacks and a 100% record as a seller and have been through many disputes. The item was simply not as advertised and you are well within your rights to ask for your money back. Paypal will instantly debit the money from the sellers account and the dispute will proceed until you win the dispute, the monies will then be credited back to your paypal account. Just a note, it is really important that you get all the information you need before purchasing items from ebay as you lose quite a proportion of time trying to sort things out when you could be fiddling with your new bit of kit. Hope I have been of help.

Wouldn't bother doing this, just a waste of time really. E-bay and Pay-pal are the same company, for any dodgy goings on like this always file a dispute with Pay-pal including evidence such as emails the seller has sent to you.

A few years ago I bought a brand spanking new top of the range (at that time) Samsung E700 mobile phone, couldn't wait for it to arrive so I could have a play. It arrived first thing a couple of days later, 180 quids worth of sparkling Samsung beauty. I murdered the packaging to get into it and opened the box. I scanned the inner box articulately inspecting everything therein, charger....yes, manual.....yes, USB cable.....yes, software.....yes, and for a full house the phone.....no such luck! Unravelling in my mind the last 5 minutes I remembered that the box felt remarkably light when handed over by the postman. Gutted! Seller swore blind he put the phone in the box before dispatch and silly me unfamiliar with paypal and ebay left it too late too claim going through the buyer to try to get it sorted. Ended up losing 180 quid and forking out another 180 quid to get another one. He had around 9 positive feedbacks at 100%, moral of the story is try to buy from a trusted seller and if it looks too good to be true it probably is!

Leave bad feedback and file a dispute. I think the money will come back into your account as its on hold until good feedback is left or 21 days have passed.

dont worry mate you will get your money back but it will take upto a week or two just go through the ebay and paypal channel and forget talking to the seller

Good feedback doesn't make the slightest bit of difference, you think it would but this is not the case. I sold an amazon voucher on ebay I was then left positive feedback for it, then a couple of days later the guy filed a dispute with paypal stating that he had not received the code I sent him and they gave him his money back, it was only after 9 emails to paypal and proof in the form of emails he had sent me stating that he had used the voucher and received the code did I get my money back!

Positive feedback means nothing on e-bay when filing a dispute!

Well I know what. But if the payment is on hold, then good feedback will release it, and bad feedback will ensure it doesnt get released.

the problems of ebay, theres guatanteed at least 4 or 5 threads a day about problems with it, why not just buy the items from a shop, yes u pay more but its guaranteed and in perfect nick!
