a friend of mine got clamped today she was being dropped of in an private property area.the engine was stil running and she got out of the car to change places with the passenger when noticed she had been clamped.the people on site wanted £300 for the removal of the clamp and also the cancelation of the tow truck.
Need to know where she stands and does she has a case of getting her money back and who can she seek for legal advice

I got a clamp on private land and the time on the ticket was 3 mins before I even turned up. I had to pay them £100 to get the clamp off.
It was a private car park right next to a public one, I genuinely didnt realise, but needed my car to get my baby from nursery so had to choice but to cough up. I hate the people that either watch u getting out the car and then clamp you as soon as you out of view, or to do it while the car is still running is just mad too.

I want more info on this...to be clamped while changing places? Seems bit odd to me...Surely it takes longer than 30 seconds to put a clamp on a car and call the tow truck.

if you pulled up.. and a clamper came over to your car, you would see them... and then get driving befire they had chance..

Maybe you have quoted what you were told, but no way did clampers strike whilst 2 people were swapping seats.

If it is on private land I would think there is little they can do without witnesses, clampers will just claim they parked there and they clamped it in accordance with the signs.

Were there any signs etc?

my wife was in the passenger seat i was about to get out of the car when this woman knocked on her window and asked if she had a permit she replyed no and stated that her friend was just bein dropped of the woman was talking to her and asking her all these questions and while this was going on a guy had put a small clamp on the back and then the woman was writing out a ticket the guy the put a large clamp on the front wheel.the engine was stil running thats what i cant work out

yes signs where put up on walls but was at a bit of a height you could not see them if you did not look up

If your story is true then more fool you for allowing them to clamp you.

I would have gone ballistic and removed the clamp myself.

i know it sound silly but on the ticket it states that if i push or threaten any body then i would incure a £50 charge

I wasn't saying deck the busy body jobsworths, who enforces these 'fines' if they are private residents who were clamping and fining I thought you could basically laugh in their faces and just remove the damn clamp

So the issue is -

You wife's friend drove to where she was going, she got out the car and went wherever she was going. 5 Mins* later your wife, who was the passenger, was moving to the drivers side to drive home**. Just as your wife was getting out of the car, a woman appeared asking what she was doing and if she had a permit, whilst talking to this woman, a man put a small clamp on the rear of the car, and a large clamp on a front wheel. Your wife has paid £300 to have clamps removed and tow truck cancelled. And your not looking for advice?

* Please state exact time as it has gone from seconds to minutes

So she was kept imprisoned in the car by the woman who was talking to her? If so, see if they have any CCTV footage of the area as this is a criminal offence.

If not, why couldnt she get out of the car?

The OP is full of it, the story has changed from getting out to swap with passenger and noticed she'd been claimed to someone talking to her while the car was being clamped

my wives friend was driving the car and had a meeting at the job center my wife was in passenger seat.Her friend got out and walked off,that when this woman asked my wife if she had a permit to park here my wife then told her she is not parking here just going now and was going to drive her friends car.This woman was stalling her until this guy put a small clamp on the rear of her car so she couldnt drive it away as the engine was still running.while this was going on he had put a large clamp on the front.i think that it was easy money to be made they even told her she had to get £300 in a hour or the car will be removed by a tow truck
