Advice on Ebay item that's been returned to me

A guy bought a brand new Sat Nav from me. Have sold a few of these and only have one left. The model he's sent back is even different to what the one left as I checked. It looks like he's returned an older model as the position of the stickers and the buttons are a completely different layout.

I posted the item at the start of the week. He's returned the item to me, but replaced the brand new with a broken and used model claiming that's what he received from me.

How do I proof that the item I sent was brand new as it's my word against his?

i write down the serial numbers now of any pricey item that i sell also take a picture of the item and serial number with my phone so i can prove what i sent, i know it doesn't help but might be worth considering next time:oops:

The cheek of some people!! I would first send an email to the buyer stating that he has not sent back the one you sent him, tell him you have the serial number of the Sat Nav you sent him and you will report to the police for fraud. See what he says!

Hopefully you took pictures of the serial number on the box (if there was one) to prove that it's not the correct one.

I'd also be tempted to "send the boys" around to his house for small greeting!

If he did then I'd still report it to the police anyway because it is fraud! Why should he get away from it? As long as you can prove he's sent a different one back to you it's fine. If you have the receipt it may have the serial number on it? It's not happened to me before and if it did I certainly won't let that scum have his way!

sorry to hear about this,but tbh I simply cant see how you can prove what you sent him. Even photos,serial numbers of an item etc-how can this PROVE thats what you sent him. In actual fact,what stops him calling YOUR bluff and saying the broken one you now have isnt what he sent?

its sickening that people do this,but I just cant see that the police would be interested-they will know that its your word against his and unproveable either way.

If it wasn't sent back to you recorded/special delivery then you are sorted - simply claim ignorance

Buyer can try and claim money back through Paypal - Paypal will tell buyer to return the item and provide the tracking number

True, but there's nothing stopping him from sending a box of stones back to the OP tomorrow recorded just so he can prove he sent something.

Two wrongs don't make a right, and people shouldn't be suggesting you be as dishonest as the buyer. Stick to the truth. Of course it's disgraceful that the buyer has tried to rip you off.

Who will Paypal side with?

Surely I can prove by photo to what he sent me back is not even the same model, without the need for a serial number?

I reckon they would go with the buyer, but with no recorded delivery number you would deffo win

You cant prove it,Did you open every box to see what was inside ?. Are you sure you didnt send that one ?. Where did you get them ?

technically it isnt fraud by saying you havent received the item back as he hasnt actually sent the item.

but you cant m8-thats the point-how can you prove with a photo that HE sent you it? and that that wasnt what you sent him in the first place? I feel for your predicament.I hate scammers but a photo doesnt prove a thing.

He could do that, but if the OP was to check the package before signing it (which you've every right to do), he could just refuse the delivery.

It's not ideal, but if the buyer is being this dishonest, I'd just claim that I hadn't received the item. That way, the buyer has got what he paid for, and the OP isn't out of pocket...
