Hi,

In the process of buying a contract phone basically just for the contract/sim as it will work out cheaper than my usual payg top-ups and I'm just wondering where I stand on selling the new phone on via ebay etc?

It's only a 12 month contract but the phone should fetch £350 making the contract in effect cost me around £60 total for a years sim/internet use.

Am I "allowed" to sell the phone? would the buyer have a warranty to fall back on?

All a bit of a grey area?

what kind of phone is it as i know my N96 has 2 years warranty , i think all the buyer will need is your email reciept or delivery slip

It's a HTC Hero....I think it comes with 2 yrs warranty also but was really wondering if it was legit and "OK" to sell the phone on and keep the sim/contract...... I'm sure there's plenty on ebay who wouldn't give a rats ass but I'd feel happier if I was NOT to potentially shaft a fellow ebuyer if he/she needed a repair down the road, at least if what you say is right re the warranty then that's something.

last year when i got a new contract i took sim out and put it in another phone 02 called me wthin 24hrs saying they knew it wasnt in proper phone and was breaking terms of contract something about 3 months it had to be in phone so check with your provider

The only problem would be that if you sold your phone and kept the sim , if you lost your other phone with the sim card in and called up to block the simcard , the phone they sent with it would be also blocked to as they block the IMIE :thumbsup:

perfectly legal to sell the phone as once you get the sim the phone is your property :thumbsup:

ps if you sell it dont state it has warranty so they have no comeback on it

the warranty is not with the contract providor anyway its with the manufacturer so the buyer can register the phone on the web

Did they say which terms and conditions you were breaking? I can't see how that is allowed as the phone is not part of the contract.
