Hi,
Basically i need some advice. I bought a mini laptop/netbook thing off someone on here.
I paid £60.00 by bank transfer and followed all advice/rules on here regarding contact telephone numbers etc.
Any how, the seller promised he was sending by courier and was arranging it straight after i paid so it would be delivered 48 hours later (on the Weds)
Anyhow the following day he got suspended so i couldnt contact him on here.
I finally got a response from him by email saying he was suspended so couldnt send the item as he could access my pms on here to get my address (even though he should of sent before he got suspended.) Anyway i re sent my details by email and he said he was sending that day. When it didnt come the following day (he suspension was up on here) i pm'd him and he said he would definately send the next day. Once again within an hour he got suspended again. I emailed him loads of times and he kept promising.
Then he ignored my emails for a few days so i sent an email stating i would take further action if i didnt get a refund or the laptop sent.
He finally emailed back saying as he was suspended he needed my details agin so hadnt been able to send it, even though i had previously emailed them to him.
I did this again and he emailed last thursday and said definately sending that day so i would recieve friday, once again no laptop turned up so i emailed him agin. This time he said he sent it on friday so would be here before 12 on saturday. Then on saturday he emailed saying he didnt realise parcelforce dont deliver on a saturday so it would be here before 12 on monday. All this time i kept asking for a tracking number and he ignored me.
Finally yesterday he emailed me a tracking number and it is a recorded signe for royal mail tracking number sent that day at 4pm. Well anyhow i finally get it today and guess what...................

IT WONT TURN ON!!

The power light comes on and goes straight off agin. At first i thought both of the batteries must be flat so have tried leaving both on for an hours charges and still doesnt turn on.
I have emailed him but he hasnt replied yet.

Any advice on whatt to do please???

(Sorry for long post but wanted to explain nearly everything that happened to show how patient i have been with him)

i'm only paying for stuff via paypal protected from now on, i've been scammed twice (low value items but still)

Thanks, i have had lots of contact with the mods over this for the last 10 days and have used the contact us a few times. Just reported this update to say i have recieved it and it is faulty to admin and he has sent an email to the member but just wanted to know what else i could do.

occasionally you do meet sellers like this. they give sites like this a bad name. i think with paypal your covered for purchases up to £200. i may be wrong though.
Only thing is, they might say it was your fault for not asking for pics of the laptop turned on and working..

Yeh i know. Its a bad world these days. Its sad no-one can be trusted. It seems though even if you use paypal you arent completely protected unless via ebay.
I suppose he would of just provided paypal with the tracking number and then not much they can do as he would of already had the money taken out of paypal weeks ago.

have mods explained why he is suspended? does he not pick up phone calls? and do you have his address? phone him dude!

Yeh i know, i didnt even think about the pics of it on and working to be honest. I do have emails and pms as proof of him saying itworked perfectly etc. Also he said it would come with the case/laptop bag thing and he didnt send that.
To be honest he sent it in a box quite alot bigger than the laptop with no padding wrapped around it or anything, just a jiffy envelope on top of it.
Also the fan cover thing wasnt on it properly and has the screw missing out of it.

papal will still only cover your for item not received outside of ebay, whereas this would fall under significantly not as described:thumbsup:

i know this sounds silly, but take the battery off the laptop. press and hold the power button for 10 seconds, plug in the adaptor and see if it works. if not, i would say it could be a serious issue and not worth messing about with. if you are lucky it will be the ram, if you are unlucky, i would say its gonna be the motherboard.

this sort of selling should not be allowed on here. when you pay via bank transfer, there is no security.

maybe get someone that knows a bit about computers to take a look? unless you know much about them?

Well yes i was thinking that as well but to be fair i think it was faulty before he sent it. (Maybe a good way of trying to claim from royal mail - but as he only sent recorded not enought compensation) I may be wrong but i believe it was already faulty.

Yep i have just tried that and before i put the battery back on (but the charger plugged in) it just did the same as what it does with the battery plugged in. I might be wrong but it seems like both batteries are knackered. I dont have much knowledge with computers but it seems it does the same thing with the battery on it or without it on it with the charger plugged in.

This is an email reply i just got from him:

It was working fine when it left here.

I am irritated by your tone and frankly I couldn't really care less right now. You bought it from me, I sent it working and thats as far as my obligation goes.

Don't keep threatening legal/police/whatever action as this is rubbish, I have sent my laptop which has worked perfectly for years. If it has been damaged during transit then it is your responsibility to contact the royal mail.

I have better things to be doing at this difficult time, and will not correspond further with you.

You could try RM but you're only covered upto 36 pounds and i wouldn't fancy your chances especially if wasn't packed properly to begin with.

To be honest if i do it it will be purely for satisfaction reasons. But is it worth paying another 50% of the item price on the chance he might pay up. Also maybe he has done this before and is cliver by getting me to pay into a bank account thats not his 1st name.
Also he told me the other day that the reason it was delayed was because his dad dies of cancer that weekend. That is why i have been patient and trying to be nice. But from his last email i copied above i think he is on the con!!

On the claim form it asks whether you are the sender or the recipient so either can do it.

On ebay, saying a family member has died is one of the most frequently used excuses and in most cases a complete lie,sad but true i'm afraid.

There was a guy yesterday on BBC news who was jailed for 18 months for conning people on ebay, his first excuse for to buyers was that his mum had died, then he went as far as to phone up the local paper posing as his dad to say he had been killed in a fire!!!!!!!

Once you make the claim and he agrees to pay up then he would have to pay for your costs anyway, i know its a pain but im sure he wont do it again, and the ruling is enforcable by the courts

Yes i am quite aware of that. Its disgusting to say that if its untrue!! absolutely diabolical.
For some reason i have a stange feeling and believe the account in which i transferred to is his dads account. As its a mans name with the same surname.
Also it seems he is only 21. I dont even know why i am saying that but.....................

You're claiming for a damaged item,i'm not sure how that process goes as i've not done it,but you have proof of delivery as it was sent RD wasnt it.

I was just advising you,whether you choose to make a claim is obviously upto you.

The person who left feedback for your seller twice has collected items from him,perhaps you could check with him if his address etc is the same as the one you have.

I know and he only made £23k, you would think that if someone was going to go to the lenghts of pretending to be dead he would at least do it for an amount of money he could retire on!!!!

I dont think he can ignore it as it is legally enforcable by the court, im pretty sure he would poop his conning pants if anything dropped through his door, hes probably sitting at home thinking hes not going to do anything for £60,

Hope you get it sorted out, might be an idea to go down the small claims route, also if he sold the other laptops email the buyers to see if they have had problems, if they have then contact the police
