I hope someone can please advise me.
I've just ordered an item on a catalogue and added it to my credit account, I've also received the confirmation email stating the correct description of the item. However, after just checking my account online it states a different catalogue no. and subsequently a different product in the range.
So my questions are: If I receive the incorrect item. Does the catalogue under the Distance Selling Regulations, Sale of Goods Act or anything else have a legal reponsibility to send me correct one if..
1) I've ordered what was shown on the screen.
2) I've added it to my credit account rather than paid immediately by card.
3) In the email order confirmation the description is correct, but somehow the cat. no is now different.
When you submit an order to us on our website you will receive a 'bounce back' confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery.
I obviously wouldn't have known of a potential problems if I hadn't checked my online account and relied on the confirmation email alone. I hope the above makes sense.
