Advice sought regarding TV not collected by company?

Sorry about the vague title, but was just wondering what you would do in my position?

I ordered a TV and the packaging arrived in a wet and battered condition. The company agreed to send a replacement and to collect the first one, they would arrange courier collection. The replacement one arrived and I am delighted with it, however they still haven't collected the first one 2 weeks later, despite giving me the return code and address etc to put on it.

I know this isn't classed as unsolicited goods, but I was just wondering where I would stand really with it. Will I be able to keep it if a certain amount of time has elapsed? Would you contact the company and let them know that they have forgotten to collect it if it were you or just hope that they forget for a very long time? (They are an extremely large company by the way, not a small family business or anything like that)

Decisions, decisions!?!

Any thoughts/advice on this much appreciated

Personally, I would let them know again as they may bill you for the second TV after a period of time has elapsed.

argos did that with us for a large piece of furniture, they never did come to collect the old one. So we fixed the damage and kept it. (we waited 2 months)

Sorry to possibly burst your bubble, but similar happened to my friend and it was flagged up 6 weeks later.

But, you never know, so fingers crossed.

So it is possible that they could 'forget' to collect it then. Did you contact Argos at any point and remind them to come and collect the furniture?

We haven't opened the box so don't know if there was much damage, but possibly not.

the only time we contacted them was to tell them it was damaged on arrival and wanted a swap, the argos truck turned up a week later, dropped of a new one and refused to take the returns "that will be arranged later".
We just left it at that.

IIRC the law is almost the same as in unsolicited goods. except that you have to contact them and from that point on they have one month to recover the goods before they become your property. but a quick call to consumerdirect should answer your query.

Hi

My parents bought a unit from a well known store, the glass shelf was broken.

They delivered a new one , never picked up the old.

18 months later they still have two units but only ever paid for the first one.

My advice would be wait and see if your brave enough.

Exactly the same, I thought when they dropped off the replacement that they would take the first one but the delivery driver wouldn't have any of it as it wasn't on his list to collect!

Thanks for that bit of advice, the website address is http://www.consumerdirect.gov.uk/ for anyone wanting similar advice. I have just rang them and they were extremely helpful, basically said I should send a letter recorded to say that they should collect the TV within 14 days. Also said that the company could claim under some liability legislation or other up to 6 years later!! Hmmm, what to do...

The way I see it is it's up to them to contact you. Unless a free TV is a big inconvenience? :w00t:

Just remember to keep notes, who you spoke to and at what time for future reference...it goes a lot better for you if you can say well I spoke to Joe from customer services on the 19th who said they would arrange collection....they can't argue with that then. I tend to keep quiet and see what happens...keep a close eye on your accounts.

Same happened to me bought a coffee table for £350 from allders before they went bust was told that i have got no chance of a coffee table from them as its now in the hands of the receiver. So i took the one from the showroom floor and told them if they cannot supply anymore to the public then they would not need the one on the showroom floor after a bit of agg i got it but the best surprise was 3 months later i got a another one delivered sold it on ebay for £250. KEEP IT

Had same problem with the old Telewest set top box

mate had his for 3 months, was about to buy it off him (naughty) and they came and got it the day later lol

So i guess, if they want it, they'll deffo be back :/

Keep you're gob shut. I received 13 mobile phones (for my work) and then they sent 13 more (by mistake). They said they would send a courier, but never did. That was 3yrs ago!
