ALL 3 customers contracts before 1/6/08 are invalid - CANCEL NOW

seaniboy Avatar

All discontinued priceplans that are billed by the second WILL NO LONGER be billed by the second for the first minute & itemised billing is now £1 from 1/7/08

this follows the 1 minute rule which many customers on MnM left Oct/Nov ended up leaving 3

3 should have sent letters to everyone not just VTT700 customers as the June 08 3guide states this is applicable to all non MnM plans in point 15 of the 3 guide, so most of us never got 30 days notice of changes I have Directtalker 1000 & Videotalk 500 & never recieved a word of change of T&C surrounding itemised billing or 1 minute rule & that when I signed up my T&C never said anything about this being a promotion as sly3 state in the lastest 3 guide dated June 08

ASAP call 3 have them place a note on your a/c per you were never informed as per your T&C with 30 days notice & also the change is not effective because you were never notified of the change & you would like to cancel on this grounds & the grounds you will not accept the change and 3 has invalidated thier own T&C of your whole contract

I called 3 cancellations its closed but explained to nice woman my T&C were not that this was a promotion till 30/6/08 & itemised billing I will not pay for as it was free & I had no 30 day change of T&C in regards to changing ( " use internet to download " - TELL them only internet I have is on my 3 handset )me to billed IB, she noted cancellation & her name I have written down, call cancellations tommorrow to get PAC

its underhand & unacceptable what 3 has done

important documents on bottom right http://three.co.uk/personal/help_sup...ion_/index.omp then 3 price guide, bootom page of pdf - FOOTnotes section 15

http://three.co.uk/personal/help_sup...rtant_docs.omp

smallprint pdf

section 10.1 subsection D

infact failure to give you 30 days notice on any contract/upgrade taken before the end of May 2008 on both the itemised billing & per second for your first minute is a change in T&C not notified to you & is a breach of the 30 day rule of informing you of the change of T&C, 3 cant enforce the changes & invalidated thier own T&C of your contract by not writing to you all if your non MnM contract started before 1/6/08

this promotional till 30/08 that 3 speak of came into force in June when the new updated 3 guide was produced, all customers SHOULD have got a letter that were on old/discontinued priceplans before June

This has already been on here, it's only specific customers and they're being migrated on a gradual basis. IF you receive a letter then you can cancel, if you don't, or you got it more than 30 days ago, you can't.

Most of what you've said is based on fact, but you've got the important details a bit "confused".

read 3 guide for June 2008, all customers should have had 30 days notice before 1/6/08 on:

1) removal per second billing for first minute

2) itemised billing charge of £1 which was free ( this includes all MnM customers )

breach 1
Did all you MnM customers get informed of the £1 " detrimental change " of free itemised billing ? with 30 days notice to accept T&C/cancel if you did not accept this change on 1/7/08 ?

breach 2
Did all non VT700 cusstomers on old priceplans get a 30 day notice to accept T&C/cancel if you did not accept this
" detrimental change " of your first minute of any call NOT being billed per second ?

breach 3
3's failure to notify you of both/either of these changes is a breach of 3's own T&C/UK law and your 3 contract T&C become uninforcable

Hi,

I took out a '£20 Texter' plan just before Christmas, does this apply to me, as in could i legally get out my contract?

Could someone in the know please reply, as could be beneficial to me!

Thanks in advance!

ALL contracts before 1/6/08 are uninforcable.........

no 30 days notice on itemised billing £1 " detrimental change to your priceplan "

all 3 contracts will have this applied from 1/7/08

see three.co.uk----important documents---small print :section 10.1 D

see three.co.uk----important documents---3 price guide : 2nd last page * free itemised billing until 31/6/08 "

^is only applicable to contracts from date of publication ( not in previous releases ) ie publication is June 2008 - 30 days notice lapses today....( 3 customers before ~June 08 are able to leave penalty free ) had 3 informed you to allow acceptance/cancellation, 3 didnt inform customers & no 30 days notice is a breach under 3terms/UK law, making thier own T&C null & void

Same here.. took Mix and Match 1100.... I am really surprised they would charge me for Itemized Bill, does that mean we are eligible to cancel contract? I have no intimation from them yet about this.. I knew only when I saw HUKD! :?

If You Took Before 1/6/08 Yes - Cancel.... Itemised Billing Is Now Part Of Your Pricepaln From 1/7/08, You Should Have Had 30 Days Notice, You Didnt, Contract Not Enforceable

I'm not disputing that customers affected can cancel, only that it's highly unlikley anyone ia ffected. The changes came into place last November for all M&M customers, and they have introduced another few tariffs since then. The most recent band of customers affected is VTT700 so if you received a letter in End of May/Start of June and you called to cancel then they will allow it. Otherwise, you cannot cancel.

Anyone taking their contract after November last year will not have the ability to cancel as it was added to the Terms and Conditions at that point in time, even though they weren't enforced immediately on all price plans.

In short, VTT700 customers may have a chance to cancel now, but the letters weren't send around the 30 day mark so they'd need to be calling now, even then they might be too late.

Other tariffs will change later in the year so if you have a 3 contract that began or upgraded prior to November 07 and haven't had a letter yet then keep your eyes open for one. If not, then you still have to complete your contract.

FYI - The only company at the moment that don't do this for contract customers are Orange, that's the same Orange who finished last in this years industry Customer Satisfaction surveys, so join them at your peril!

I might give them a call, cheers for the headsup

I am very confused by all these threads, is there no easy guide to who can and can't cancel ?
#16
Doesn't affect direct talker 1000.

Thanks for that. Though it might be changing for us in the next few months I heard?

I just HATE their customer services. Roll on changes.

Can anyone find in the T&C that they are going to charge £1 for itemised billing??? I have rang three and they told me this is not the case. I havelooked at T&Cs on there website and I cant find anything that says you will be charged for bill. Am I missing something? Help please because my eyes are blurd with all this reading lol

I have just rang 3 to try and cancel on the Itemized Billing charge. They are useless. First they didn't know anything about it, so I had to guide the Customer Service Rep to the Price Guide and the correct page, where it states Fully Itemised Bill - £1.00 (free until 30/06/2008), to which after checking with his manager he said the Price Guide was wrong at that there will be no charge. Might try again later to speak to a different person, maybe say I received a letter saying I had 30 days to change. Looks like enough people have already cancelled tdue to the charge that they have scrapped it.

I am on the m&m 700 after upgrading in feb, I have rang them and they told me that yes this is the case, as of the 1st july I will be charged for itemised billing. So I told him I wanted to cancel my contract as I had not been given notice, he said he would transfer me to the correct dept and after 5mins of being on hold I was cut off. I am now in a queue to go through it all again.

I will let you know how I get on

See this is that I hate, I was told that I would not be charged for itemised billing. Do they even have a clue what they are doing? Did you go straight through to cancellations or via some other department first?
#29
The plot thinkens lol After my last post (above) I have called three back and they are now denying that there will be a charge and that if the £1 does show on my bill then if I call them they will deduct it!!!! Guilty as charged I would say. I have now been told a manager will call me in the next couple of hrs to discuss this. I will give them until 1pm and call them back.

Watch this space lets see what excuse they come up with now. I am going to save a copy of the charges to my desktop, just in case they happen to take it off there wedsite or change things.

333 manager informed me these changes were first stated in the 3guide dated June 08 and came intoforce on 1/6 and yes we should have been informed
#32
There are no immediate plans to charge for itemised billing, the price guide has always said that a charge applies and the "free until..." date has just changed every time it gets close to it so it looks like someone forgot to change it this time. It will happen eventually as part of the drive to move everyone to paperless statements and checking their details on My3.

As the price has been in the price guide, regardless of whether or not it was initially free, you'd have a hard time trying to cancel because a company has started charging you for something that they always said they were going to!

As useful as these forums can be, and MSE as well, your best checking with Trading Standards rather than taking the word of someone on here (myself included). It's free and they'll let you know if you have genuine cause for complaint.
#33
I'm afraid you've been given incorrect info, if you PM your details i'm happy to send you a copy of the announcement of the change (from last October). ALL customers affected are being notified approximately 6 weeks before the change affects them and they have 30 days in which to cancel, but there are literally only a few hundred customers affected by each change now (reducing with each new price plan that migrates) as the customer base on each affected price plan is much smaller as most customers took out contract after, or upgraded after, the 1st Minute Billing was brought in.

Hope that helps.

I'm stuck with three on Talk & Text 600 until December, I've actually had the contract since around 2005, £30 a month. I would love to get down to one of their £15 a month tariff's they're offering in the stores now, would my contract be eligible for cancellation? I've had no communication from 3 at all apart from my bills, and no mention on them about changes to billing or price etc. :) Forgot to mention I extended it by 18 months back in September-ish last year on an upgrade.
#37
Dopey bloke alert...

I am on VTT500, since june 2007 (18 month contract) I have not received any letters stating changes to either per second billing or £1 for itemised bills, does this affect me.

Would dearly love to leave 3 as customer service is appalling (although would change my mind if they reduced me to £1.24 a month for 200 mins and text!!)
#38
Just spoke to 3 customer services and they say that this issue ONLY affect Mix & Match plans and VT700 only,

THIS DOES NOT AFFECT ALL DISCONTINUED PRICE PLANS AS MENTIONED!!!

doesnt apply to direct talk 1400

I think the OP means that there is a change to the billing for discontinued Price Plans which allows you to get out of your contract
