Did they give a reason (ie: goods have been used/damaged by customer)?¿

Was it an auction or a buy now item with a set price?

appealed what?
Did you request to return it under the DSR's or did you open a paypal dispute?
If they just refunded you then what are they appealling against?

I requested a return under the DSR's and they refused in the first instance, I eventually managed to get them to agree to it, then 3 weeks after they received the item no refund so I contacted paypal and they opened the dispute

why did they refuse? You should contact trading standards too if your return was legitimate

they said that it stated clearly in their listing that all sales where final, I couldnt see where it said that, nor could ebay when I phoned them, it also said on their listing that they did accept returns

Well reply to the appeal saying you returned them under the DSR's, suply the tracking information and mention they are breaking the law by not accepting returns.
Also report them to their local trading standards and mention that in your response too.
As long as you have proof of delivery they shouldn't win any case.

no I only tried them on they were still in perfect condition, and they seller hasnt said anything otherwise plus they had them back 4 weeks ago now, I sent them recorded and have proof it was signed for 4 weeks ago, I just thought it was all settled, still out of pocket on the return postage, but I guess I will have to live with that, sure took some not very nice emails to get them to let me return them anyway, ebay were not much help

I already supplied paypal with the tracking info which is why paypal refunded me in the first place, I just dont understand how it can be appealed now

Depends on if it was Ebay or PP, you say PP so it should be ok but I was waiting for an item for over a month from Ebay and the seller kept making excuses so when I opened an Ebay dispute they sent me a replacement despite me saying I wanted a refund, so I refused delivery of item and Ebay awarded in their favour so the seller got money and item.

Ebay keeps changing their stances on things so its hard to tell.
